127 thousand Seven hundred and twenty five Cometh the Said Alexander Hall by Levin Gale his attorney afd and the Sherr of Somersett County to whom the foregoeing Writt was directed Likewise Cometh and maketh Return thereof Endorsed viz.t Cipi Corpora Francis Allen Sher And whereupon the afd W.m Southy Esther and Hannah Whittington Ex.rs as afd in their Own proper persons Come and defend the force and Injury when &c and say that they Cannot gainsay the action afd so as afd against them brought nor Can they Say but that the Said plft Ought to recover his damages by occasion of the premisses afd to Nine hundred and Seventeen pounds of tobo and and Cost of Suite against them to be Levied of the goods and Chattells of the afd Stephen's White dec.d Therefore it is Considered by the Justices here the same day and year Last menconed that the afd Alexander Hall Recover against the afd W.m Southy, Esther and Hannah Whittington Exrs of the Last will and testament of Wm Whittington Esqr Late of Somersett County dec.d who was Ex.r of the Last will and testament of Stevens White Late of Somersett County Gent dec.d as well the Sum of Nine hundred and Seventeen pounds of tobo his damages afd in form afd Confesed as also the Sum of 197 pounds of tobo by the Court here adjudged unto him for his Costs and Charges by him about his Suite in this Behalfe Laid Out and Expended to be Levied of the goods and Chattells which were of the Said Stephens White at the time of his death in the hands of W.m Southy, Esther and Hannah Whittington Executors as afd Remaining to be administred if so much thereof in their hands they have &c and if so much thereof in their hands they have not &c then the Costs afd to be Levied of the proper goods and Chattells of the afd W.m, Southy, Esther and Hannah Whittington's and the afd deft in mercy &c
are Ready to Surrender upon and humbly Prayeth the Benefitt of the Late act of assembly & Your Petitioners in duty Bound Shall Ever pray Arthur Hayman Edward Peacock The Petition afd being read and heard and the premisses Considered and the afd Arthur Hayman and Edward Peacock both Present in Court ^the Said Edwd Peacocke^ made oath according to act of assembly (Entituled an act for the Relief and releas of Poor distresed prisoners for debt) that he had not any Estate Reall or personall in Possession Reversion or Remainder of the value of forty Shillings in the whole or suficient to pay the debt or Damages for which he was detained in Custody &c thereupon the Justices did remand the said Peacock to prison and gave a Certificate in writing from under their hand and Sealls to the afd Edward as the Law directs &c Likewise the Said Ed Arthur Hayman present made Oath according to the afd act that the goods debts and Effects and Estate which he had delivered up assigned and made Over to the Justices of Somersett County Court in trust for the use of his Creditors in the whole Estate which he had &c |
