&c   And Whereupon the same Jos: by Levin Gale his attry Complains that Whereas the
afd W.m South day of December one thousand seven hundred & twenty five at Somrsett County
afd within the Jurisdiction of this Court was Indebted to the same Jos: in the Sum of Six hundred
and twelve pounds of tob.o as by acc.o herewith into Court brought may appear & so thereof being Indebted
the same W.m in Consideration afterwards to wit the Same day & year afd at the County afd
within the afd Jur thereof upon himselfe assumed & to the same Jos: then & there faithfully
promised that he when afterwards he should be thereto required he the afd sum of six
hundred & twelve pounds of tob.o to the same Jos: MaClester woud well & faithfully Content &
pay Nevertheless the said Will.m his promis & assumption afd in form afd made Little regarding
& plotting & fraudulently intending the same Jos: in that part Craftily & Subtily
to defraud & deceive he the s.d Sum of Six hundred & twelve pounds of tob.o or any part thereof
to the same Jos: (altho the afd W.m afterwards to witt the same day & year afd Last mentioned
& afterwards at Somrsett County afd within the Jur afd by the same Jos: was requested
hath not paid or him for it in any wise Contented but the said W.m the same hitherto to doe hath
altogether refused & Still doth refuse to the dam of the same Jos: twelve hundred pounds of tob.o
and thereof he bring this Suite &c                   L Gale P Quer pledges &c    Jno Doe Rich.d Roe

               Whereupon the said W.m Lockwood in his own proper person Cometh & defendeth
       the force & Injury when &c & says that he Cannot gainsay the Plft his action afd so as afd against
       him brought nor Can he say but that the said Plft ought to recover his dam by occation of the
       primises afd to Six hundred & twelve pounds of tob.o & Costs of Suite against him brought
       which the said Plft doth not gainsay &c

                            Therefore it is Considered by the Justices ^here^ the fifteenth day of March anno Dom
       one thousand Seven hundred & twenty five that the afd Jos: McClester recover ag.t the afd W.m
       Lockwood as well the Sum of Six hundred & twelve pounds of tob.o his Dam afd in form afd
247   Confessed as also the Sum of Two hundred and forty seven                           pounds of tob.o
       by the Court here adjudged unto him for his Costs & Charges by him about his Suite in his
       behalfe Laid out & Expended & the afd Deft in mercy &c
