the said Joseph then & there faithfully promised that he when afterwards he should be thereto
requested he ye said sum of six hundred & Ninety Six pounds of Tob.o to ye same Joseph would well
& faithfully Content & pay Never ye less ye said Tobias his promiss & assumption afd in form afd
made Little regarding & plotting & fraudulently Intending the same Joseph in yt part craftilly
& subtilly to deceive & defraud he ye said sum of six hundred & Ninety p.ds of Tob.o or any
part thereof to ye same Joseph (although ye afd Tobias afterwards to witt ye same day & year
afd Last mentioned & often afterwards at Somrsett County afd within withe Jurisdiction afd
by ye same Joseph now requested hath not paid or him for it in any wise Contented but yt he
ye said Tobias ye same hitherto to doe hath altogether refused & still doth refuse whereby
the same Joseph says he is worse & hath damage to ye value of three thousand pounds of

             Whereupon the Said Tobias Pepper Present in Court is at the prayer of the plfts
             attorney adjudged to give Speciall Bail to the action afd   Thereupon a Certain William Merchement
             of Somersett County Planter present here in Court undertakes for the Said Tobias Pepper
             that if in Case the Said Will Joseph MccClester Shall recover Judgm.t in the plea afd against the
             afd Tobias Pepper or that the Said Tobias Pepper Shall be therein Convict that then he ye
             said Tobias Pepper shall pay the Condemnation of the Court thereupon unto the said Joseph
             Mcclester or render his Body to the Custody of the Sherr of Somersett County in satisfaction
             thereof or that he the Said William Marchm.t will do it for him &c

                               And thereupon the Said Tobias Pepper in his own proper person Cometh and
             defendeth the force and Injury when &c and says that he Cannot gainsay the Plft his action afd so
             as afd against him brought nor Can he Say but that the Said Plft Ought to recover his damages
             by Occasion of the premisses afd to Six hundred and Ninty Six pounds of tobo and Costs of
             Suite against him the Said Plft doth not gainsay &c 

                                  Therefore it is Considered by the Justices here the fifteenth day of March anno
             Dom One thousand seven hundred and twenty five that the afd Joseph MccClester Recover ag.t
             the afd Tobias Pepper as well the Sum of Six hundred and Ninty Six pounds of tobo his damages
266       afd in form afd Confessed as also the Sum of Two hundred and Sixty Six                     pounds
             of tob.o by the Court here adjudged unto him for his Costs and Charges by him about his Suite in this
             behalfe Laid Out and Expended and the afd Deft in Mercy &c
