in our County Court of Somersett here (to witt) on the Seventeenth day of March anno Dom one thousand Seven hundred & twenty three before the Worshipfull Jos: Gray & his associates then our Justices of our said Court at Dividing Creek & by Consideration of our said Court Obtained his Execution of a Certain Judgm.t against a Certain Henry Williams of Stepney parrish in ^the^ the County afd Planter & Alice his wife adm.rx of a Certain Tho.s Taylor Late of Somersett County decd as well of the Sum of Eighty hundred & eighty five pounds of tob.o a Certain debt together with the Sum of two hundred & fifteen pounds of tob.o Costs of Suite as also the sum of two hundred & Sixty one pounds of tob.o by the Court here adjudged unto the said Benj.a Wailes for his Costs & Dam Sustained by Occation of delay of execution of the Judgm.t afd all ^which^ Such Sums afd to be Levied on the Goods & Chattells which were of the afd Tho.s Tayler at the time of his death & which to the hands of the afd Henry Williams and Alice his wife admrx as afd should after Come to be administred if so much thereof in their hands they Should leave whereof they are Convict as by the record & process thereof in our said Court remaining before the Justices thereof Manifestly appeareth & altho' the Judgm.t afd as yett remaineth unsattisfied as by the Insinuation of the said Benj.a Wailes we have received & because we are willing that those things which in our Said County Court are rightfully done Should Come to a due Execution we Command you that by good & Lawfull men of your Bailywick you make known unto the Said Henry Williams & Alice his wife that the be & appear before our said Justices at our County Court of Somersett to be held at Dividing Creek the third tuesday of March next to Shew Cause if any thing for themselves they have or Know to say why the afd Benjamin Wailes his Execution of the Judgm.t afd against them the said Henry Williams & Alice his wife admrx as afd (according to the form of the recovery afd he ought not to have) if to them it Shall Seem mete & further to do & receive what our said Court Shall Consider of & have you then & there the names of those by whom you make the same Known & this Wittness Samu.ll Hopkins Gent Chief Justice of our Said Court the 19.th day of Novem in the 10.th year of our Dominion &c Ann Dom 1725 Thomas Hayward Clk Att which said third tuesday of march to witt the fifteenth day of the Same month anno Dom One thousand seven hundred and twenty five being the day of the return of the said Writt Cometh the said Benjamin Wailes by his attorney afd and the Sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed viz.t Scir Faci P Fran Allen sher Whereupon the Said Benjamin Wailes by his attorney afd prays that the afd Henry Williams and Alice his wife Admrx as afd to his writt of scirefacias afd may answer but the Said (Henry) |
