                   A Copy of the foregoeing declaration and account were made and sent with to be Served on the
             deft with the writt in the plea afd &c          Att which Said third tuesday of march to witt the fifteenth
             day of the Same month anno Dom One thousand Seven hundred and twenty five being the day of
             the return of the Said Writt Cometh the Said Joseph MccClester by his attorney afd and the Sherr of
             Somersett County to whom the foregoing writt was directed Likewise Cometh and maketh Return
             thereof to the Court here Endorsed in these words following viz.t  Cepi Corpus Copy decln delivered in time

                         Whereupon the Said Jno Barkley being Called appears and thereupon the said John Barkley
             being Called appears and thereupon the Said John Barkley at the prayer of the Plfts attorney
             afd is adjudged to give Speciall Bail to the action afd thereupon a Certain Richard Plunkett of
             Somersett County Planter Present herein Court undertakes for the Said Jn.o Barkley that In
             Case the Said Joseph MccClester Shall Recover Judgm.t in the plea afd against the Said John
             Barkley or that the Said John Barkley Shall be therein Convict that then he the Said John
             Barkley Shall pay the Condemnation of the Court or render his Body to the Custody of the Sherr
             of Somersett County in Satisfaction thereof or that he the Said Richard Plunkett will do it for him
            
                        Whereupon the Said John Barkley in his proper person Cometh and defendeth ^the^ force
             and Injury when &c  And Says that he Cannot gainsay the plft his action afd so as afd against
             him brought nor Can he Say but that the Said Plft Ought to recover his damages by Occasion of
             the premisses afd to two thousand and twenty two pounds of tobo and Costs of Suite against him
             which the Said plft doth not Gainsay &c

                                    Therefore it is Considered by the Justices here the fifteenth day of march anno
             Dom One thousand Seven hundred and twenty five afd that the afd Joseph MccClester Recover agt
             the afd Jn.o Barkley as well the Sum of two thousand and twenty two pounds of tobo his damages
(430)    afd in form afd Confessed as also the Sum of Four hundred and thirty                                 pounds
             of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his Suite in this
             behalfe Laid Out & Expended & the afd deft in Mercy &c
