to answer unto Joseph MccClester of a plea of trespass upon the Case &c and that thereof he Should not fail &c And the Said Joseph MccClester by Levin Gale his attorney Proceeded against the Said John Barkly in the plea afd as followeth viz.t Somersett County fs John Barkley Late of Somersett County Planter was attached to answer unto Joseph Macclester of a plea of trespass upon the Case &c And whereupon the said Joseph by Levin Gale his attorney Complains that whereas the said John the thirtieth day of Novem Ann Dom one thousand Seven hundred & twenty foure at Somersett County afd within the Jurisdiction of this Court was Indebted unto the said Joseph unto the said Joseph in Two thousand three hundred and Eighty two pounds of tob.o for Levies Sherr fees & Publick dues to the said Joseph then and there due owing and unpaid as by an acc.t thereof hereunto annexed may in Court appear and being so thereof Indebted the said John afterwards to witt the same day & year afd at the place afd in Consideration thereof upon himselfe assumed and to the said Joseph then and there did faithfully promise that y.e s.d John the afd two thousand three hundred & Eighty three pounds of tob.o to y.e s.d Joseph when he should be afterwards thereunto requested he would well and faithfully pay and Content and altho the said John three hundred & Sixty pounds of tob.o percell of the afd two thousand three hundred & Eighty two pound of tob.o to y.e s.d Joseph he hath paid and Sattisfyed yett as ^to^ two thousand and twenty two pounds of tob.o residue of the afd two thousand three hundred & Eighty two pounds of tob.o the said John his premis & assumption afd inform made Little regarding but Plotting and fraudulently Intending the said Joseph in that part Craftilly ad Subtitlly to deceive and Defraud the afd two thousand & twenty two pounds of tob.o to y.e s.d Joseph he hath not paid or it to him for the same in any wise Contented altho' the same to doe the said John by the said Joseph on the first day of August Ann Dom one thousand seven hundred and twenty five & often afterwards at the County afd within the Jurisdiction afd he was thereunto requested but ye same to him to pay or in any wise to Content hath refused & Still doth refuse and deny whereupon the Said Joseph saith he is wors & hath damage to y.e value of four thousand and forty four pounds of tob.o and thereupon he brings this Suite &c
