as also the Costs accrueing upon the writt of attachment afd and that the said Thomas Dasheill have
his Execution thereof against the said Samuel Bratton according to act of assembly &c

Pse     John Barkley
 Command was given to the sherr of Somersett County that he should take John Barkley
late of Stepney Parish in the County afd Planter if he should be found in his Bailiwick and
and him should Safe Keep so the he might have his Body Before the Justices of his Lordships
                   County Court of Somersett to be held at dividing Creek the third tuesday of august then next to answer unto
Levin Covington of a plea that he render unto him two thousand four hundred good staves of white oak full three foott Long
&c and that then he should not fail &c    And the said Levin Covington by Levin Gale his attorney declares against the
said John Barkley in the plea afd as followeth vizt    Somersett County ss.t  John Barkley late of Stepney Parish in the
County afd Planter was sumoned to answer unto Levin Covington of a plea that he render unto him two thousand four hundred
good staves of white Oak full three foott Long &c       And whereupon the said Levin Covington by Levin Gale
his attorney saith that whereas the afd John the thirteenth day of January One thousand seven hundred and thir twenty
two three at the Parish afd within the Jurisdiction of this Court by his Certain Bill Obligatory which the said Levin
Covington Brings here into Court whose date is the same day and year afd obliged himselfe to pay and deliver unto
the afd Leving Covington two thousand four hundred good staves of white Oak full three foot Long by the Last day
of march next Ensueing the date of the said Bill  Nevertheless the said John altho' often thereunto requested the
afd two thousand four hundred good staves of white Oak full three foot Long as afd to the said Levin Covington
hath not Rendered but he the same to the said Levin Covington hitherto to render hath altogether denyed and still
doth deny whereby the said Levin Covington says he is worse and hath damage to the value of four thousand eight
hundred Like staves and thereof he Brings suite &c    Levin Gale P Quer Pledgs &c Jno Doe R Roe

       Att which said third tuesday of August to witt the twentieth day of the same month ann Dom One thousand seven
hundred and twenty three being the day of the return of the said Writt Cometh the said Levin Covington by his attorney
afd and the sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh return
that the writeing Obligatory afd is his act and deed and that the debt therein mentioned is yett due and unsatisfied
wherefore the said plft prays Judgm.t for his debt afd and his Costs and damages sustained by occasion of the
detaineing the same debt to him to be adjudged &c
                                                       Therefore it is Considered by the Justices here the twentieth day of august ann
Dom One thousand seven hundred and twenty three afd that the said Levin Covington recover against the said
John Barkley as well the sume of two thousand four hundred good staves of white oak full three foott Long his
266   debt afd as also the sume of Two hundred & sixty six                                pounds of tobacco by the Court
here adjudged unto him for his Costs and damages sustained by Occasion of the detaineing of the the same
debt to him to be adjudged &c and the deft in mercy &c
