    August Court      1723            95
Att which said third tuesday of august to witt the twentieth day of the same month ann Dom One thousand seven
hundred and twenty three Being the day of the return of the said Writt Cometh the said Thomas Dasheil by his
attorney afd and the sherr of Sommersett County to whom the foregoeing Writt was directed Likewise Cometh
and maketh return thereof to the Court here Endorsed in these words following vizt   By vertue of the
within Writt to me directed to the Justices within Mentioned I Certifie that I have attached as the goods and
Chattles rights or Creditts of the Within Named Robert Perry to the value of two hundred and fifty pounds
of tob.o in the hands of John Tull and five hundred pounds of tobacco in the hands of Samuel Bratton and
I further Certifie that I have Given Notice unto the said George John Tull and Samuel Bratton that they
be and appear before the Justices within Mentioned at the time and place within Contained to shew Cause if
any they have why the same should not be Condemned in their hands towards satisfying of the within Named
Thomas Dashiell his damages and Costs within Contained before Mathew Hopkins and John Doe good and
Lawfull men of my Bailiwick as by the within Writt I am Commanded so answers Jos: MccClester Sherr
       Whereupon the afd John Tull Garnishee of ^the^ afd Robert Perry appears in his Own proper person and
says that he Cannot gainsay but that he hath of the Rights and Creditts of the said Robert Perry to the value
of two hundred and fifty pounds of tobacco nor but the same Ought to be COndemned in his hands for the
use of the said Thomas Dasheill as of the rights and Creditts of the said Robert Perry which the said
plft doth not gainsay
                               Likewise the said Samuel Bratton Garnishee of the afd Robert Perry appears
in his Own proper person and says that he Cannot gainsay but that he hath of the rights and Creditts of
the said Robert Perry to the value of five hundred pence to be paid in Country Product nor but that
the same Ought to be Condemned in his hands for the use of the said Thomas Dasheil as of the rights and
Creditts of the said Robert Perry which the said plft doth not gainsay
             Whereupon the said Thomas Dasheill by his attorney afd prays the sums afd so as afd
Confesed by the afd John Tull and Samuel Bratton as of the rights and Credits of the said Robert Perry
may be Condemned in the hands of the said John Tull and Samuel Bratton towards satisfying unto the
said Thomas Dasheill as well the sume of twelve hundred pounds of ^tobacco^ as al Cost accrueing upon this
writt of attachmt.t
                                                     Therefore it is Considered by the Justices here the twentieth day of august
ann Dom One thousand seven hundred and twenty three that the said sume of two hundred and fifty pounds
of tobacco so as afd attached and Confessed be Condemned in the hands of the said John Tull as of the rights
and Creditts of the said Robert Perry towards satisfying unto the said Thomas Dasheill as well the sume
of twelve hundred pounds of tob.o afd as also the Costs accrueing upon the writt of attachment afd and
that the said Thomas Dasheill have his Execution thereof against the said John Tull according to act of
assembly
                                Therefore it is Considered by the Justices here the same day and year Last mentioned
that the said sume of five hundred pence to be paid in Country product so as afd Confesed be Condemned
in the hands of the said Samuel Bratton as of the rights and Creditts of the said Robert Perry towards
satisfying unto the said Thomas Dasheill as well the sume of twelve hundred pounds of tobacco afd
