        two at the Parish and County afd within the Jurisdiction of this Court was Indebted unto the said Robert in One
        thousand two hundred and sixteen pounds of tobo for Levies Sheriffs fees and Publick dues and forbearance
        thereupon to the said Robert then and there due Owing and unpaid as by an acco.t thereof hereunto annexed may in
        Court appear and being so thereof Indebted the said David afterwards to witt the day and year afd at ye Place afd
        in Consideration thereof upon himselfe did assume and to the said Robert then and there did faithfully Promise that
        he the said David the afd One thousand One hundred and sixteen pounds of tobacco to the said Robert when he
        should be afterwards thereunto required he would well and faithfully pay and Content and altho' the said David
        six hundred and seventy pounds of tob.o Pcell of the afd One thousand two hundred and sixteen pounds of
        to have to the said Robert he hath paid and satisfied yett as to five hundred and fifty six pounds of tobacco
        residue of the afd one thousand two hundred and sixteen pounds of tobo the said David his promise and assumption
        afd in form afd made Little regarding but Plotting and fraudulently Intending the said Robert in that part
        Craftelly and Subtilly to deceive and defraud the afd five hundred and forty six pounds of tobacco to the said
        Robert he hath not paid or to him for the same in any wise Contented altho' the same to do the said David by
        the said Robert the first day of December in the year afd and often afterwards at ye Parish and County afd
        with in the Jurisdiction afd he was thereunto requested but the same to him to pay or in any wise to Content
        hath refused and still doth refuse and deny  Whereupon the said Robert saith he is worse and hath damage
        to the value of one thousand and Ninety two pounds of tob.o and thereupon he Brings Suite &.c

                                                                                                 Errors Excepted P me Robt Martin
                                              Att Which said third tuesday of march to witt the Nineteenth day of the same month
        Ann Dom One thousand seven hundred and twenty two being ye Day of the return of said foregoeing writt
       Comes the said Robert Martin by his attorney afd and the Sherr of Somrsett County to whom the same writt was
       directed Likewise Comes and makes return thereof to ye Court here Endorst in these words following vizt
                                                                                                                         Cepie Jos: Manchester Sherr
                   Whereupon the said David Shehe being Called appears and thereupon the said David Shehe at ye
       Prayer of ye Plfts attorney afd the said David Shehee is adjudged to give Speciall Baile to the action afd thereupon
       a Certain Joseph M.ccChester of Somrsett County Gent Present here in Court undertakes for the said
       David Shehe that in Case the said Robert Martin shall recover Judgmt in the Plea afd against the said David
       Shehe or that the said David Shehe shall be therein Convict that then he the said David Shehe shall pay the
       Condemnation of the Court thereupon unto the said Robert Martin or that he the said Joseph MccChester will
       do it for him                  Whereupon the said David Shehe in his Proper Person Comes and defends the
