78 Att which said Next Court to witt the Eighteenth day of June ann Dom One thousand seven hundred and twenty three Comes againe the said Defendent by his attorney afd and offers himselfe against the said Plft in the plea afd But the said plft altho' solemnly Called Comes not nor is his declaration in the Plea afd further prosecuted against the said deft Therefore it is Consideration by the Justices here the Same day and Year Last menti: Mentioned that the said Richard Edge and his Pledges of Prosecuting that in John Doe and Richard Roe be in Mercy &c and that the said John Paynter Goe thereof without day and further it is Considered by the Justices here that the said John Paynter Recover against the said Richard Edge the sume of (314) three hundred & fourteen pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his defence in this Behalfe Laid Out and Expended according to the form of the statute and that the said John Paynter have thereof his Ext
Adams and M.r James Robertson and the award of the said partys or any two of them to be finall and Conclusive to End all differences in dispute between the said alex Alexander Carlyle and the said John Jones and Judgm.t to be given on the return as of this Court Afterwards viz.t the Eighteenth day of June Ann Dom One thousand seven hundred and twenty three Levin Gale and Alexander Adams two of the persons mentioned in the rule of refoirence made return of their award in the premisses as followeth viz.t Somersett ss To all Christian people to whom in these presents shall Come Wee Alexander Adams and Levin Gale sends Greeting whereas M.r Alexander Carlyle and Capt John Jones the thirtieth day of aprill One thousand seven hundred and twenty three at a Court held for the County afd at Dividing Creek submitted all differences whatsoever to the award and determination of the afd Allexander adams and Levin Gale and the reverend M.r James Robertson or any two of them according to the form of the Statute in this Case made and provided Now Know ye that wee the said Allexander adams and Levin Gale have taken upon us the Burthen of the said arbitram.t and fully Considered the premisses do award thereon as follows that is to say first that the afd John Jones do pay to the afd Alexander Carlyle four shillings and six pence Curr.t money of maryland within two months after the date hereof secondly that the said Alexander Carlyle do pay unto the said John Jones within five months of the date hereof all the Costs laid out about a suite Lately Commenced by the afd Allexander Carlyle ag.t the afd John Jones in the County afd according to bill of Costs to be made out by the Clk of the said County and all Costs on this award &c and lastly that the afd Alexander Carlylele and John Jones on the paym.t of the said sums of money and tob.o shall sign seall and deliver to Each Other Mutuall releases of all differences whatsoever |
