69 June next to shew Cause if any he hath or Knoweth to say why the said Thomas Collier and Ann his wife adm.rs as afd should not have their Execution of the Judgm.t afd according to the form of the recovery afd against him the said Thomas Goddart if to them it shall seem meet and how you shall Execute this Writt that you make Known unto the Justices of our said Court at the same day and place together with the Names of those Before Whom you make the same Known and this Writt Witness Charles Ballard Gent Chiefe Justice of Our Said Court the 3d day of may in the Eighth Year of Our Dominion &.c Ann Dom 1723 Thomas Hayward Clk G Dashiell) Att which said third tuesday of August to wit the Eighteenth day of the same month Ann Dom One thousand seven hundred and twenty three Being the day of the return of the said Writt Come the said Thomas Collier and Ann his wife adm.rx as afd by their attorney afd and the Sherr of Sommersett County to whome the foregoeing Writt was directed Likewise Comes and makes return thereof to the Court here Endorst in these words following vizt By vertue of the Within Writt to me directed to the Justices within Mentioned I Certifie that I have given Notice unto the Within Named Thomas Goddard that he be and appear at the time & and place within Contained before the Justices within Mentioned to shew Cause if any he hath or Knoweth to say why the within Names Thomas Collier and Ann his wife admrx as within Mentioned should not have their Execution against him for the Debt and Cost within Contained before Hugh Porter and John Doe good and Lawfull men of my Bailiwick as by the Within Writt I am Commanded so answers P Jos: MccChester Sherr Whereupon the said Thomas Collier and Ann his wife admrx as afd by George Dashiell their attorney Offers prays that the said Thomas Goddart to their writt of Scire facias afd may Answer But the said Thomas Goddart altho' solemnly Called Comes not but makes default whereby the said plfts remain against the said deft wholy undefended &c Therefore it is Considered by the Justices here the Eighteenth day of June Ann Dom One thousand seven hundred and twenty three that the said Thomas Collier & Ann his wife admrx as afd I have their Execution against the said Thomas Goddart for as well the Sume of sixteen thousand pounds of tobacco their debt afd as also the sum of three hundred and fifty One pounds of tobo Costs of suite in the Judgm.t afd specified as also the sum of Three hundred & Twenty Nine (329) pounds of tobo by the Court here adjudged unto him for his Costs and Damages sustained by occasion of Delay of Execution of the Judgm.t afd &c
Answer unto William Lane of a plea of trespass upon the Case &c and that thereof he should not faile &c And the said William Lane ^by W.m Tazewell his attry^ declared against the said Joseph Pemberton in the Plea afd as follows viz.t (and) |
