1723 60 John M.ccChester by his attorney afd and the sherr of Sommersett County to whom the foregoeing writt was directed Likewise Comes and makes return thereof to the Court here Endorst in these words vizt Cepi Answers Jos: Whereupon the said Thomas Johnson in his Own Proper Person Comes and defends the force & Injury when &.c and says that he Cannot gainsay the Plft his action afd so as afd against him Brought nor Can he say but that the said Plft Ought to recover his damages by occasion of the Premisses afd to the sum of Nine hundred and fifty pounds of tobo and Costs of Suite against him which the said Plft does not gainsay &.c Therefore it is Considered by the Justices here the Eighteenth day of June Ann Dom One thousand seven hundred and twenty three afd that the said John MccChester recover against the said Thomas Johnson as well the sume of Nine hundred and fifty pounds of tobacco Certain damages (244) afd in form afd Confesed as allso the sume of Two hundred and forty four pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his suite in this behalfe Laid Out and Expended and ye Deft in mercy &.c
should Safe Keep so that he might have his Body Before the Justices of his Lordships County Court of Somrsett ^to be held at Dividing Creek^ the third tuesday of June then next to answer unto Mr William Whittington of a plea that he render unto him six pounds one shilling and seven pence Corant mony of this Province which to him he Ows and Unjustly detains &.c and that thereof he should not fail &.c And whereupon the said William by Francis Allen his attorney saith that whereas the said Robert the twenty third day of March One thousand Seven hundred and twenty at the Parish and County afd within the Jurisdiction of this Court by his Certain Bill Obligatory which the said William with the seall of the said Robert signed here into Court Brings the date whereof is the same day and year did acknowledge himselfe to be Bound unto the said William in the afd six pounds one shilling and seven Pence money afd to be paid unto the said William when he should be thereunto requir's Yett the said Robert tho' often required the Said six pounds One Shilling and Seven pence to the afd William hath not paid but the same to him to pay hitherto hath denyed and still doth deny and unjustly detain to the damage of the said William of twelve pounds money afd and thereupon he Brings Suite &.c F Allen P Querre Pledgs deft Jno Do Richd Roe Att which said third tuesday of June to witt the Eighteenth day of the same month Ann Dom one thousand seven hundred and twenty three Being ye Day of the returne of the said Writt Comes the said William Whittington by his attorney afd and the sherr of Sommersett County to whom the foregoeing writt was directed Likewise Comes and makes return thereof to the Court here Endorst in these Words vizt Non Est Inventus Shorte note Lefte Jos: MccChester Sher Whereupon the said William Whittington by his attorney afd Prays that for as much as he has Complyed (with) |
