59 sort to Content altogether hath refused and still doth refuse to the damage of the said Robert of five pounds of Curr.t mony of Maryland and thereupon he bringeth suite &.c Allen P Quert Pledgs deft Jno Doe R Roe Att which said third tuesday of June to witt the Eight^eenth^h day of the same month Ann Dom One thousand seven hundred and twenty three Being the day of the return of the said Writt Comes the said Robert Nairne by his attorney afd and the Sherr of Sommersett County to whom the foregoeing Writt was directed Likewise Comes and makes return thereof to the Court here Endorst viz.t Cepi Corpus P Jos: MccChester sher Whereupon the said Charles Ramsey and Abraham Lamberson in their Own Proper persons Come and defend the force and Injury when &.c And say that they Cannot gainsay the Plft his action afd so as afd against him brought nor Can they say but that the said Plft ought to recover his damages by occasion of the Premises afd to the sum of twenty two shillings silver Currancy and one hundred and seventy four ^two^ pounds of tobo and Costs of Suite against them which the said Plft does not gainsay &.c Therefore it is Considered by the Justices here the Eighteenth day of June Ann Dom One thousand seven hundred and twenty three afd that the said Robert Nairne recover against the said Charles Ramsey and Abraham Lamberson as well the sum of twenty two shillings Silver Currency of maryland and One hundred seventy four ^two^ pounds of tob.o Certain damages afd in form afd Confesed as also (309) the sum of Three hundred and Nine Pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him ^about his Suite^ in this Behalfe Laid Out and Expended and ye Defts in mercy &.c
his Lordships County Court ^of Somrsett^ to be held at dividing Creek the third tuesday of June then next to answer unto Robert Martin of a plea of trespass upon the Case &.c and that thereof he should not faile &.c And whereupon the said Robert Martin by Francis Allen his attorney Complains that whereas the said Robert Pitts the thirtieth day of November Ann Dom: One thousand Seven hundred and twenty two at ye Parish and County afd within the Jurisdiction of this Court was Indebted unto the said Robert Martin in four thousand One hundred and Ninty three pounds of tobacco for Levies Sherr fees and Publick dues and forbearance thereupon to the said Robert Martin then and there due Oweing and unpaid by an accot thereof hereunto annexed may appear and being so thereof Indebted the said Robert Pitts in Consideration thereof afterwards to witt ye Day and Year afd at the Place afd in Consideration thereof upon himselfe did assume and to the said Robert Martin then and there faithfully did promise that the the said Robert Pitts the afd one four thousand One hundred and Ninty three pounds of tobacco to the said Robert Martin when he should be afterwards thereunto requested he would well and faithfully pay and (Content) |
