58 Plfts by their attorney afd and the sherr of Sommersett County to whom the foregoeing But Writt was directed Likewise Comes and makes return thereof to the Court here Endorst in these words vizt Cepi Corpus P Jos: MccChester Sherr Whereupon the said Edward Hull in his Own Proper Person Comes and defends the force and Injury ^when^ &.c and says that he Cannot gainsay the Plfts their action afd against him brought nor Can he say but that the writing Obligatory afd is his act and deed and that the debt there in Mentioned is Yett due and unsatisfied wherefore the said Plfts Prays Judgm.t for their debt afd and their Costs and damages Sustained by Occasion of the detaineing of the same debt to them to be adjudged &.c Therefore it is Considered by the Justices here the Eighteenth day of June Ann Dom One thousand Seven hundred and twenty three that the said Ebenezer Handy and Priscilla his Burton Executors of the same Samuell Handy sen decd Recover against the said Edward Hull recover as well the sum of seven hundred pounds of tobo his debt afd as also the sum of Two hundred and forty Two (242) pounds of tobacco by the Court here adjudged unto them for their Costs and Char damages sustained by Occasion of the detaineing the same debt with Stay of Execution till the tenth of November Next &.c and ye Deft in mercy &.c
if he should be found in his Baliwick and him should Safe Keep so that he might have his Body Before the Justices of his Lordships County Court ^of Somrsett^ to be held at Dividing Creek the third tuesday of June then next to answer unto Richard Bennett of Queen Anns County merch.t of a plea that he render unto them him two Pounds five Shillings Curr.t Silver mony of this Province which to him he Ows and unjustly detains &.c and that thereof he should not faile &.c And whereupon the said Richard by Francis Allen his attorney Complains and Saith that the said Sommersett the tenth day of February Ann Dom One thousand seven hundred and twenty One at ye Parish and County afd within the Jurisdiction of this Court by his Certain Bill Obligatory did Bind himselfe his heirs Executors and administrators to pay or Cause to be paid unto the said Richard the afd two pounds five shillings at ye Dwelling house of the said Richard at or upon the tenth day of march next Ensueing Yett the said Sommersett tho' often required the said two pounds five Shillings according to ye Contents of the Said Bill to the Said Rich.d hath not rendered Butt the same to hi hitherto to render or hath denyed and still doth deny and unjustly detaine to the Damage of the said Richard of five pounds mony afd and thereupon he Brings suite &.c F: Allen P Quert Pledgs deft Jno Doe & richd Roe Att which said third tuesday of June to witt the Eighteenth day of the same Month Ann Dom One thousand seven hundred and twenty three Being the day of the return of the said Writt Comes the said Richard by his attorney afd and the Sherr of Sommersett County to whom the foregoeing writt was (directed) |
