         The vestry of Somrsett
          Parish
Command was given to the sherr of Sommersett that he should take Thomas Laws, George

Bozman Sen Thomas Dashiell of manny, John Jones, William Stoughton and Capwell
King late of Sommersett Parish Gent vestrymen of the said Parish and William Sasser
                                  and Underwood Roucher late of the said Parish Church Wardens thereof if they should be found in his
       Baliwick and them should Safe Keep so that he might have their Bodys before the Justices of his Lordships County
       Court of Sommersett to be held at Dividing Creek the third tuesday of June then next to answer unto Thomas Cary
       of a plea of trespass upon the Case &c  and that thereof he should not faile &c
             And the said Thomas Cary by Levin Gale his attorney Proceeded against the said Thomas Laws George Bozman
       Sen Thomas Dashiell of Many John Jones Wm Stoughton Capell King W.m Sasser and underwood roucher in
       the Plea afd as follows vizt
                                                                Sommersett County ss.t Thomas Laws George Bozman sen Thomas Dashiell
                of many John Jones William Stoughton and Capell King late of Sommersett Parish Gent vestrymen of
                the said Parish and William Sasser and underwood Roucher late of the said Parish Church Wardens thereof
                were attached to answer unto Thomas Cary of a plea of trespass upon the Case &c
                            And whereupon the said Thomas by Levin Gale his attorney Complains that Whereas the afd vestry and
       Church Wardens the thirtieth day of aprill Ann Dom One thousand seven hundred and twenty three in their
       afd Capacities were at Sommersett Parish afd in the County afd within the afd Jurisdiction Indebted unto the afd
       Thomas four thousand five hundred pounds of tobacco for the Like Sum received by the vestry men and Church Wardens
       of the said Parish of the said Cary for the use of the said Cary applied towards defraying ye Parish Charges and so
       thereof being Indebted the said Thomas Laws George Bozman sen Thomas Dashiell John Jones Wm Stoughton
       Capell King William Sasser and Underwood Roucher the day and year afd at the Place afd within the afd Jurisdiction
       in Consideration thereof upon themselves assumed and to the said Cary then and there faithfully Promised that the afd
       sum of four thousand five hundred pounds of tobacco when afterwards the said Cary should of the vestry ^men^ and Church
       Wardens of the parish afd request it by them to the said Cary it should be paid and Contented Nevertheless the afd
       Thomas Laws George Bozman Sen Thomas Dashiell John Jones William Stoughton Capell King W.m Sasser and
       Underwood Roucher vestry men and Church Wardens as afd their promise and assumption afd in form afd made
       Little regarding Butt Plotting and fraudulently Intending the afd Thomas Cary in that Part to defraud and deceive
       the afd sum of four thousand five hundred pounds of tobacco or any Part thereof to the afd Thomas (altho' the afd
       Thomas Laws George Bozman Sen Thomas Dashiell John Jones William Stoughton Capell King Will.m Sasser
       and Underwood Roucher was thereunto requested afterwards to witt the fifth day of may one thousand seven hundred
       and twenty three at Sommersett Parish afd within the afd Jurisdiction hath not paid or in anywise Contented but they
       and Every of them the same hitherto to pay or in anywise Content have altogether refused and still doth refuse whereby
       the said Thomas says he is the worse and hath damage to the value of Nine thousand pounds of tobacco and thereof
       he brings this suite &c       L Gale P Quer Pledges &c Jno Doe & Richd Roe
                      A Copy of the foregoeing declaration was made and sent with the writt in the Plea afd &c
       Att which said third tuesday of Au June to witt the Eighteenth day of the same month ann Dom One thousand
       seven hundred and twenty three Being the day of the return of the said Writt Comes the said Thomas Cary by his attrny
       afd and the sherr of Sommersett County to whom the foregoeing was directed Likewise Comes and makes return
