Yett as to the residue Being fifteen hundred and thirty Eight pounds of tobo he hath not paid altho' often
thereunto requested but the said Thomas but the same to pay hath refused and still doth refuse to the damage of
the said Thomas the sum of three thousand and seventy pounds of tob.o and thereupon he Brings the this

       Att which said third tuesday of June to witt the Eighteenth day of the same Month ann Dom one thousand
seven hundred and twenty three Being the day of the return of the said Writt Comes the said Thomas Dashiell by his
attorney afd and the sherr of Sommersett County to whom the foregoeing writt was directed Likewise Comes and makes
return thereof to the Court here Endorst in these words vizt               Cepi Corpus P Jos: Macchester Sherr
                                  Whereupon the said Edward Hull in his Own Proper person appears Comes and defends
the force and Injury when &c and says that he Cannot gainsay the Plft his action afd so as afd against him
brought nor Can he say but that the said Plft ought to recover his damages by Occasion of the Premises afd
to the sum of One thousand five hundred thirty Eight pound of tobo and Costs of Suite against him which ye
said Plft does not gainsay &c                                                 Therefore it is Considered by the Justices here the
Eighteenth day of June Ann Dom One thousand seven hundred and twenty three afd that the said Thomas
Dashiell Recover against the said Edward Hull as well the sum of One thousand five hundred thirty Eight
pounds of tobacco Certain damages afd in form afd Confesed as also the sum of Two hundred and forty five
45 Cost           pounds of tobacco by the Court here adjudged to him for his Costs and Charges by him about
his suite in this Behalfe Laid Out and Expended with Stay of Execution till the tenth of November next and ye Deft
in mercy &c

Command was given to the Sherr of Sommersett County that he Should take Jonathan Raymond
of Stepney Parish in Sommersett County Planter if he should be found in his Bailiwick
and him should Safe Keep so that he might have his Body Before the Justices of his
                      Lordships County Court of Sommersett to be held at Dividing Creek the third tuesday of June then next
             to answer unto Henry Toadvine of the Said County Planter of a plea of trespass upon the Case &c  and that
             thereof he should not faile &c   And the Said Henry Toadvine by George Dashiell his attorney Proceeded
                                                                                                                                                             (against)
