38 And twenty three on which day and year Last mentioned Come again as well the said Plft by their their attorney afd as the said deft by his attorney afd and the said deft as before defends the force and Injury when &c and saith that he is not guilty of the trespass above Imposed on him in manner and form as the Plfts in their declaration hath Complained and of this he putts himself upon the Country Dashiell P Deft And the Pltfs in Like manner Allen P Qrtebus Thereupon Command is given to the sherr of Sommersett County that Immediately he Cause to Come here twelve &c by whom &c who Neither &c to recognize &c because as well &c of which said Preceipt the said sherr to witt Joseph M.ccChester Gent Now here at to witt the same day and year Last mentioned makes return that he has here ready twelve &c as by his said Preceipt he was Commanded and now hereafterwards to witt the same day and year Comes as well the said Plfts as the said deft by their attorneys afd and the Jurors of that Jury Impannelled being Called Likewise Came to witt William Lane John Dennis Sen John Pope Henry Scofeild Moses Fenton William mills Daniel Cowdery Neal MccChester Robert Hill Charles Townsend James Hall James West who being duely Elected tryed and sworn to say the truth in the Premisses upon their Oath do say that the said William Brereton is guilty of the Premisses above Imposed on him in manner and form as the said Thomas and Mary above against him hath Complained and do assess the damages of the said Thomas and Mary his wife by occasion of the Premisses afd to the sum of six hundred pounds of tobacco and one pound of ^tobo^ Cost besides their Costs and Charges in this Behalfe Laid out and Expended Therefore it is Considered by the Justices here the thirtieth day of aprill Ann Dom One thousand seven hundred and twenty three afd that the said Thomas Brereton and Mary his wife recover against the said William Brereton as well the sum of six hundred pounds of tobo by the Court here adjudged unto their their damages by occasion of the Premisses afd in form afd asesed as also the sum of Cost (1000) One thousand Pounds of tobacco by the Court here adjudged unto them for their Costs and Charges by them about their suite in this Behalfe Laid Out and Expended and ye Deft in mercy &c
that whereas the said John the first day of July One thousand seven hundred and twenty one at the Parish & County afd within the Jurisdiction of this Court had Paid and delivered to him the said John One Cow and Calfe of the Price of five hundred pounds of tobacco and one Sow and Piggs at the Price of One hundred and fifty pounds of tob.o the said John in Consideration thereof Pretending and takeing upon himselfe the trade of a house Carpenter and affirming himselfe in the same to be Judicious and Expert upon himselfe did assume upon himselfe ye Day Year and Place afd within the afd Jurisdiction and to the said Mary whilst she was sole then and there did faithfully Promise that he the said John One Logg dwelling house twenty foott Long and fifteen foott wide well tight and workman Like for her the said Mary upon the Plantation of her the said Mary at (Coventry) |
