Aprill Court 1723
30 William Tazewell his attorney saith that whereas the afd John and Richard the two and twentieth day of June ann Dom seventeen hundred and twenty at Coventry Parish afd in the County afd within the Jurisdiction of this Court by their Certain Writing Obligatory Which the same robison with ye seal of the afd John and Richard signed here into Court Brought whose date is the same day and year did Bind themselves unto the afd Robinson in the Just Sum of One thousand three hundred pounds of tobacco or the value of the Product of this Province to be paid to the said Robison in the Just Sume at Snow hill by the tenth day of November then next Ensueing the date hereof nevertheless the afd John and Richard altho often required the afd One thousand three hundred pounds of tobacco to the same Robison have not yet rendered but the same hither to him hitherto to render have denyed and still doth deny whereupon he saith that he is the worse and hath damage to the value of one thousand pounds of tobacco and thereof he Brings Suite &.c Tazewell P Quer Jno Doe & Rich.d Roe And the said John Harper and Richard Harper by Francis Allen their attorney Come and defend the force and Injury when &.c and prays Leave to Imparl hereunto untill the next Court and they have it and the same day is given to the Plft also Att which said next Court to witt the day of March Ann Dom One thousand seven hundred And twenty One Comes again as well the said William Robison by his attorney afd as the said John and Richard Harper by their attorney afd and the said John and Richard Harper by their said attorney afd prays further Leave to Imparle hereunto untill the next Court and they have it and the same day is given to the Plft also Att which said next Court to witt the day of June Ann Dom One thousand seven hundred and twenty two Comes againe as well the said William Har Robison by his attorney afd as the said John and Richard Harper by their attorney afd and the said John and Richard Harper by their said attorneys as prays further Leave to Imparle hereunto untill the next Court and they have it and the same day is given to the Plft also Att which said next Court to witt the day of Augt Ann Dom One thousand seven hundred and twenty two Comes again as well the said William Robison by his attorney afd as the said John and Richard Harper by their attorney af as the s and the said John and Richard Harper by their said Attorney or bef prays further Leave to Imparle hereunto untill the next Court and they have it and the same day is given to the Plft also Att which said next Court to witt the day of November Ann Dom one thousand seven hundred and twenty two Comes again as well the said William Robison by his attorney afd as the said John and Richard Harper by their attorney afd and the said John and Richard Harper by their said attorney as before defends the force and Injury when &.c and prays Oyer of the writing Obligatory afd and it is read unto them in these words following viz.t Maryland ss: This Bill Bindeth us John John Harper and Richard Harper both of Sommersett County Planters wee our heirs Ex.rs adm.rs to pay or Cause to be paid unto M.r William Robison of the same County merch.t to him his heirs (Exrs) |
