265 Keep so that he might have her body before the Justices of his Lordships County Court of Somersett the third tuesday of March then next to answer unto his ^said^ Lordship Concerning a Certain Presentm.t against her found &c and that thereof he should not fail &c Att which said third tuesday of March to witt the sixteenth day of the same Month ann Dom One thousand Seven hundred and twenty four being the day of the return of the said Writt Cometh the Sherr of Somersett County to whom the foregoeing Writt was directed and Maketh return thereof to the Court here Endorsed in these words following vizt Cepi Corpus P Jos: MccClester Sherr Whereupon the said Mary Perdue in her own proper person appears and being sett to the barr (Presentm.t Read) pleads guilty and submitts to the Mercy of the Court and makes oath that a Certain John Howard is the begetter of the Child she stands presented for and is willing to make fine to the Lord proprietary for the fact afd Wherefore it is Considered by the Court that the said Mary Perdue be fined to his said Lordship the sum of thirty Shillings for the ^fact afd toward the^ defraying of the County Charge which fine is paid to Capt John Jones for the use of the County afd thereupon the said Mary Perdue is discharged she first giveing security for paym.t of their severall Officers their Fees accrued on the premisses afd Whereupon a Certain Levin Gale of Somersett County Gent present here in Court undertakes for the said Mary Perdue to pay the severall officers their Fees due by Occasion of the premisses afd &c
the said Jane Nutt Spinster of Stepney Parish if she shoul^d^ be found in his Bailywick and her should safe Keep so that he might have her body before the Justices of his Lordship's County Court of Somersett the third tuesday of March then Next at Dividing Creek to answer unto his said Lordship Concerning a Certain Presentm.t against her found &c and that thereof he should not fail &c Att which said third tuesday of march to witt the sixteenth day of the same Month ann Dom one thousand seven hundred and twenty four being the day of the return of the said Writt Cometh the said Sherr of Somersett County to whom the foregoeing writt was directed and maketh Return thereof Endorsed in these words following viz.t Cepi Corpus P Jos: MccClester Sher Whereupon the said Jane Nutt in her Own proper person appears and being sett to the barr (presentm.t Read) pleads Guilty and makes Oath that a Certain Joseph Payvey is the begetter of the Child she stands presented for but hath not wherewith all to pay her fine for the fact afd Wherefore it is Considered by the Court that the said Jane Nutt be whipt at the publick whiping post with fifteen Lashes on the bear Back well Laid on untill the blood appear and as to the (Corporall) |
