(24) Bloodworth which the said Plfts does not gainsay Also the afd Moses Driskell Garnishee of the afd Timothy Bloodworth appears in his Own Proper Persons and says he Cannot gainsay but that he has of the rights and Creditts of the said Timothy Bloodworth in his hands to the value of Seventeen Shillings and six ^Nine^ Pence so as afd attached nor but that the same Ought to be Condemned in his hands for the use of the said Patrick Simpson as of the rights and Creditts of the said Timothy Bloodworth which ye said Plft does not gainsay Whereupon the afd Thomas Laramore Jacob Crouch, John James, Solomon Turpin and Samuel Alexander Garnishees of the afd Timothy Bloodworth ^in their^ Own Proper Persons appears and voluntarily takes their Oath with Consent of the Plfts attorney afd that they had none of the Effects of the Defts in their hands at the time of Laying the attachment afd nor at noe time since thereupon said Thomas Laramore Jacob Crouch John James Solomon Turpin and Samuell Alexander garnishees as afd were discharged Thereupon the Court adjourns untill the Last tuesday of aprill nex being the thirtieth day of the same Month Ann Dom One thousand seven Hundred and twenty three on which day and year the Court sett againe and then and there Came the said Patrick Simpson by his attorney afd And thereupon the afd Purnell Johnson, Ebenezer Cottman, William Moses James Driskill John Davis William Hitch John Brady Ales Shiles George Goddard Charles Young Naomie Shiles Thomas Horne Christopher Natter Timothy Roads Thomas Brewerton Oliver Such Thomas Caldwell James Smith John Anderson James Gosline and Sarah Price Garnishees as afd altho' ^severally^ solemnly Called Come not nor she is Cause why &.c But makes default nor does any other Person for them appear to shew Cause to ye Contrary &c Whereupon the afd said Patrick Simpson by his attorney afd Prays that the severall sums so as afd Confesed by the afd Will.m Moor Dudley Beak and Mosses Driskill as also the severall sum's afd so as afd attached in the hands of the afd Purnell Johnson Ebenezer Cottman Will James Driskell, John Davis, William Hitch John Brady Ales Shiles George Goddard Charles young Naomie Shiles Thomas Horne, Christopher Natter Timothy Roads Thomas Brewerton Oliver Such Thos Caldwell James Smith, John Anderson, James Smith Gosline and Sarah Price Garnishees afd as also the severall goods afd attached in the hands of Charles Ballard and Naomie Shiles all which sum's afd Confesed and attached as the rights and Credits of the said Timothy Bloodworth may be Condemned in the hands of the several Garnishees hands afd Towards satisfieing unto the said Patrick Simpson as well the sum of seventy two pounds twelve shill debt and Judgmt Interest as also one thousand pounds tobo Costs of suite Therefore it is Considered by the Justices here the thirtieth day of Aprill Ann Dom One thousand seven hundred and twenty three that the said sum of Two shillings and two pence part of the sum: so attached and Confesed be Condemned in the hands of the said William Moor as of the rights and Credits of the said Timothy Bloodworth towards satisfying unto the said Patrick Simpson his debt and Costs afd as also the Costs accrueing upon the writt of attachm.t afd and that the said Patrick (Simpson) |
