216 therein Convict that then he the said Benjamin Tull shall pay the Condemnation of the Court ^thereupon^ or render his Body to ye Custody of the sher of Somersett County in satisfaction thereof or that he the said Christopher Glass will do it for him &c Whereupon the said Benjamin Tull in his Own proper person Comes and defends the force and Injury &c when &c and says that he Cannot Gainsay the action of the said Henry Sparling and Levin Denwood so as afd against him Brought nor Can he say but that the said Henry Sparling and Levin Denwood should ^ought to^ recover their damages by occasion of the premisses afd to forty one shillings Curr.t money and Costs of Suite against him which the Said plfts doe not gainsay Therefore it is Considered by the Justices here the sixteenth day of June ann Dom One thousand seven hundred & twenty four that the said Henry Sparling and Levin Denwood recover against the said Benj.a Tull as well the sum of forty one shill Curr.t money his ^these^ damages afd in form afd Confesses as also the Sum of Two hundred & seventy one (271) pounds of tobacco by the Court here adjudged unto them for their Costs and Charges by them about their Suite in this Behalfe Laid Out and Expended & ye Deft in mercy &c
Whereupon the said Sturges Dickson appears and at the prayer of the plfts attorney is adjudged to give speciall Bail to the action afd but for want thereof the said Sturges Dickson is Committed into ye Custody of the sherr of Somersett County there to remain &c the said sherr Present herein Court to the Charge of the Said Sturges Dickson accordingly &c And at ye Prayer of the said Sturges dickson ye said Richard Hickman is adjudged to give security for Costs in Case Nonsuite he Obtained against in the plea afd &c thereupon Joseph MccClester of Somersett County Gent Present in Court undertakes for the said Richard Hickman that in Case the he be Nonsuited in ye Plea afd or otherwise Legally Cost that then he the said Richard Hickman shall pay the Condemnation of the Court and all Costs accrewing thereon to ye said Sturges Dickson or that he ye said Jos MccClester will do it for him &c Whereas ye sher of Somersett County had Attached in the hands of a Certain Thomas Walker & Mary Kenney as of the rights and Creditts of William Kenney &c the said Thomas Walker & Mary Kenny in their own proper person ^appears^ and with ye Consent of Thomas Howell the plfts attorney made Oath that they had none of the Effects of the said W.m Kenney in their hands thereupon they are discharged &c |
