215 Richardson, John Gillett, James Caldwell, George Benston who being duely Elected tryed & Sworn to say the truth in the premisses upon their Oath do say that the said Capell King is not of the premisses above Imposed upon him &c Therefore it is Considered by the Justices here the seventeenth day of June ann Dom one thousand seven hundred & twenty four that the afd Capell King be thereof acquitted &c and goe thereof without day &c But whereas the said Capell King being Bound to the peace at the prayer of the afd Alexd Hall who had sworn the same against him they being Now both present here in Court the said Capell prays the Court that he may be discharged from the same recognizance which by the Consent of the and at ye prayer of the said Allexd Hall he is by the Court discharged as afd is praid &c
of June seventeen hundred and twenty one at ye County afd within the Jurisdiction of this Court was Indebted to them ^the same^ Henry Sparling and Levin Denwood in the sum of forty one Shillings Curr.t money for a gun by them to the same Benjamin before that time sold and delivered and so thereof Being Indebted the same Benjamin in Consideration thereof afterwards to witt the same day and year afd at ye Place afd within the Jurisdiction afd upon himselfe assumed and to the same Henry and Levin then and there faithfully promised that he when afterwards he should be thereunto Requested the said sum of forty one Shillings to them he would well and faithfully Content & pay Nevertheless the said Benjamin Plotting and fraudulently Intending the same Henry and Levin in this Part Craftilly and subtilly to defraud & deceive the afd sum of forty one shillings or any part thereof to the same Henry and Levin (altho' thereunto requested afterwards to witt the tenth day of June Seventeen hundred and twenty three att the County afd within the afd Jurisdiction) hath not paid or them for it in any wise Contented but he the Same hitherto to pay or them for it in any wise to Content hath altogether Refused and Still doth refuse whereby they say they are the worse and have damage to the value of four pounds Curr.t money and thereof they Bring this suite &c Levin Gale P Quer Pledges &c Jno Doe R Roe Whereupon the Said Benjamin Tull being Called appears and thereupon the said Benjamin Tull at the prayer of the plfts attorney afd is adjudged to give speciall Bail to the action afd thereupon a Certain Christopher Glass of Somersett County Merch.t Present herein Court undertakes for the said Benjamin Tull that in Case the said Henry Sparling and Levin Denwood shall recover Judgm.t in the plea afd against the said Benj.a Tull or that the said Benj.a Tull shall be (therein) |
