209 said John in that part Craftilly and Subtilly to deceive and defraud the horse afd from Dorchester County to the house of Peter Sharpe in Talbott County afd did not Ride but the horse afd from Dorchester County afd unlawfully and against the will and Consent of him the said John did ride Near the space of two hundred Miles to a Certain Place Called Philadelphia in the province of Pensilvania and the said Horse in his possession and Custody in Performance of the Journey afd by the space of twelve days did Keep and unlawfully use and retain and the said Horse very much Impoverish and make worse before the redelivery of the horse afd viz.t on the sixth day of January in the year afd to him the said John at the Place afd within the Jurisdiction afd whereupon the said John saith he is worse and hath damage to the value of ten ten pounds Curr.t mony of this province and thereupon he Brings Suite &c Fran Allen P Qrte Pledgs dep Jno Doe R Roe And the said William Robins by Levin Gale his attorney Comes and defends the Force and Injury when &c and prays Leave to Imparle hereunto untill the Next Court and he hath it and the same day is given to the plft also Att which said next Court to witt the sixteenth day of June Anno Dom One thousand seven hundred and twenty four Come again as well the said plft as the said deft by their attorneys afd and the same attorney of the same deft says that he is not Informed by the same Deft his Clyant of any answer for the same deft to the afd Plft in the plea afd to be given and Nothing Els thereof Joyn by which the same plft remains against the said deft thereof undefended &c whereupon the said John Rider his damages by occasion of the premisses afd against the afd William Robins ought to recover &c thereupon Att the prayer of the said John Riders attorney and by the Consent of the said William Robins attorney the Justices do assess the damages of the said John by occasion of the premisses afd besides his Costs and Charges according to act of assembly in such Case made and provided to forty shillings Curr.t money &c Therefore it is Considered by the Justices here the same day and year Last mentioned that the said John Rider Recover against the said William Robins as well the sum of forty shillings Currt money his damages afd in form afd assessed as also the sum of three 392 hundred and Ninty Two Pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his Suite in this Behalfe Laid Out & Expended & ye deft in mercy &c
