179 Tobacco his damages afd in form afd by the Justices assesed as also the sum of three hundred & Twenty five 325 pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his suite in this behalfe Laid Out & Expended & ye Deft in mercy &c
within the Jurisdiction of this Court was Indebted unto the Said Christopher in the sum of One thousand four hundred and fifty pounds of tobacco as P acco.t hereunto annext may in Court appear and the said James Being Indebted as afd for and in Consideration afd at the time and place afd did upon himselfe assume and to the said Christopher then and there did faithfully promise that the afd one thousand four hundred and fifty pounds of tobacco he would well faithfully pay when he should be thereto requested and altho' seven hundred and thirty pounds of tobacco part of the said debt the said James hath paid yett as to the residue being seven hundred and twenty pounds of tobacco part of the said debt unto the said Christopher the said James according to his promise and assumption afd hath not paid (altho' often thereunto requested) but that the same to pay hath refused and still doth refuse to the Loss and damage of the said Christopher of Fourteen hundred and forty pounds of tobacco and thereupon he brings this Suite Dashiell P Quer Pledges &c Jno Doe Richd Roe
November ye 16.th 1723 Came Christopher Piper and made Oath in due form that the above accot is Just and true Sworn before me Jno Handy And the the said James Feillett by Francis Allen his attorney Comes and defends the force and Injury when &c and says prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the plft also A which said next Court to witt the seventeenth day of March ann Dom one thousand seven hundred twenty there Come againe as well the said plft by his attorney afd as the said deft by his attorney afd and the same attorney says that he is not Informed by the same James Feillett his Clyant of any answer by the same deft to the afd plft in the plea afd to be given and nothing Else thereof says by that the same plft remains thereof against the afd Deft thereof undefended &c for which him the said plft ought to recover his damages against the said deft by reason of the premisses afd &c Whereupon at the prayer of the same plft and by the Consent of the afd deft the Justices here do assess the damages of the same plft (according to act of assembly in Such Case provided) by occasion of the premisses afd besides his Costs and Charges by him about his Suite in this part Expended to six hundred and Nine pounds of tobacco &c Therefore it is Considered by the Justices here the same day & year Last mentioned that the said Christopher Piper recover against the said James Feillett as well the sum of six hundred & Nine pounds of tobacco by the Court his damages afd in form afd by the Justices assessed as also the sum of three hundred & seventy five (275) pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his Suite in this part Expended & ye deft in mercy &c |
