172 Francis Allen prays that the said Robert Martin to his plea afd may answer But the said Robert Martin altho' Solemnly Called Comes not nor to the plea of the said Francis answereth nor is his writt against ye said Francis further prosecuted Therefore it is Considered by the Justices here the seventeenth day of march ann Dom one thousand seven hundred and twenty three afd that the said Robert Martin take Nothing by his writt afd but that he and his pledges of Prosecuting that is John Doe & Richard Roe be in Mercy &c and of the said francis Allen goe thereof without day and also it is Considered by the Justices that the said Francis Allen recover against the said Robert Martin as well the sume of Two hundred & thirty (232) two pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his defence in this Behalfe Laid Out and Expended according to the form of the Statute &c
and at the parish afd within the Jurisdiction of this Court was Indebted unto the said Levin Covington seven hundred and fifty good pipe staves for divers goods wears and merchantdizes and so thereof being Indebted the said John in Consideration thereof afterwards vizt the same day and year at the parish afd within the afd Jurisdiction upon himselfe assumed and to the said Levin Covington then and there faithfully promised that he when afterwards he should be thereunto Requested the afd seven hundred & fifty good pipe staves to the said Levin Covington he would well and faithfully Content and pay Nevertheless the said John his promise and assumption afd in form afd made Little regarding but plotting and fraudulently Intending the said Leving Covington in that part to defraud & deceive the afd seven hundred & fifty pipe staves or any part thereof to the said Levin Covington (altho' the said John afterwards vizt the day of one thousand seven hundred & at the parish afd within the afd Jurisdiction was thereunto requested) hath not paid or him for it in any ways Contented but he the same hitherto to do hath altogether refused and still doth refuse whereby the said Levin Covington says he is the worse and hath damage to ye value of fifteen hundred pipe staves and thereof he Brings this Suite &c L Gale P Quer Pledges &c Jno Do Ri Roe And the said John Evans by George Dashiell his attorney Comes & defends the force & Injury when &c and prays Leave to Imparl hereunto untill the Next Court and he hath it and the same day is given to the plft also Att which said next Court to witt the Ninteenth day of Novem ann Dom One thousand seven hundred & twenty three Come again the said partys by their attorneys afd and the said deft by his said attorney prays further Leave to Imparle hereunto untill the next Court and he hath it & the same day is given to the plft also Att which said next Court to witt the seventeenth day (of) |
