Condemned according to act of assembly to and for the Use of a Certain Robert Martin unless the said William
Gilchrist and Thomas Brown by themselves or their attorney shall appear and answer unto the said
Robert Martin in a plea of trespass upon the Case &c according to Law and that by good and Lawfull men
of your Bailiwick you make Known unto the person or persons in whose hands you make the
same attachm.t that he she or they be and appear before the Justices of our Said Court to be held as afd
to shew Cause if any he she or they have why the same goods Chattells Rights or Creditts so attached in his her
her or their hands ought not to be Condemned and Execution thereof had and made according to the form
of the act of assembly in that Case made and provided if to him her or them it shall seem mete and how you
shall Execute this writt that you make Known unto Our Said Justices at the day and place afd and have your
then and there this writt Witness Charles Ballard Gent Chief Justice of our Said Court the 24 day of march in ye
Eight year of our Dominion &c Ann Dom 1722      A F (Allen)                              Thomas Hayward Cler
                   Att which said third tuesday of June to witt the Eighteenth day of the same month ann Dom one
thousand seven hundred and twenty three being the day of the return of the said Writt Comes the said Robert Martin
by William Tazewell his attorney and the sherr of Somersett County to whom the foregoeing writt was
directed Likewise Comes and makes Return thereof to the Court here Endorst in these words following viz.t
          To the worshipfull Justices within mentoned I humbly Certifie that I have attached in the hands of Francis
Allen as the goods and Chattells of the within Named William Gilchrist and Thomas Brown to the value of two
pounds Eight shillings and six pence and I further Certify that I have given Notice unto the said Francis Allen
that he be and appear at the time and place within Contained to shew Cause &c before John Doe & Richard Roe
good & Lawfull men of my Bailywick as by the within Writt I am Commanded Jos McClester Sher
       And the said Francis Allen in his Own proper person Comes and defends the force and Injury when &c and
prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the plft also
        Att which said next Court to witt the twentieth day of August Ann Dom One thousand seven hundred
and twenty three Come again as well the said plft by his attorney afd as the said deft in his Own proper person
and ye said deft in his own proper person prays further Leave to Imparl hereunto untill the next Court and
he hath it and the same day is given to the plft also            Att which said next Court to witt the Ninteenth day
of November Ann Dom One thousand seven hundred and twenty three Come again as well the said plft by his
attorney afd as the said deft in his own proper person and the said deft in his own proper person prays
further Leave to Imparle hereunto untill the next Court and he hath it and ye same day is given to ye plft also
Att which said next Court to witt the seventeenth day of march ann.o Dom one thousand seven hundred and
twenty three Comes again as well the said plft by his attorney afd as the said deft in his own proper person and
the said deft in his own proper person as Before defends the force & Injury when &c and saith that the afd
Robert Condemnation of two pounds Eight Shillings and Six pence or any part thereof in his hands attached
as the goods and Chattells of the afd Gilchrist and Brown ought not to have because he saith that at the time
of the Laying of the attachm.t afd he had not nor at any time since hath had any goods or Chattells of the afd
Gilchrist and Brown in his hands or was in any wise to them Indebted and this he is ready to verifie wherefore
he prays Judgm.t if the said Robert Condemnation of the premisses or any part thereof so as afd
attached in his hands thereupon Ought to have &c    F Allen in Psona            Whereupon the said Robt
