two at Coventry Parish in the County of Somersett afd within the Jurisdiction of this Court was Indebted unto ye said James in tenn pounds Eight Shillings and Eight pence Curr.t money of maryland it being as well for Sundry Medicines and Unguents by the said James to the said John at the Speciall Instance & Request of the said John before that time then & there sold and delivered as for Sundry services by the said James for the said John at the Like Speciall Instance & Request of the said John Before that time then and there done and perform'd as by a perticular acco.t thereof hereunto annexed & hereunto Court brought may appear and being so thereof Indebted the said John in Consideration thereof the day and year afd at the place afd within the Jurisdiction afd in Consideration thereof upon himselfe did assume and to the said James then and there did faithfully promise that he the said John the said tenn pounds Eight Shillings and Eight pence to the said James when he should be afterwards thereunto requested he would well and faithfully pay & Content and whereas also the said John Afterwards to witt the afd tenth day of February in the Year afd at the place afd within the Jurisdiction afd in Consideration that he the said James at the Like Speciall Instance and request of the afd John then and there had done & performed sundry services for him the said John and also then and there at the Like Speciall Instance & Request of the said John had sold and delivered unto the said John Sundry Medicines and unquents all which are perticularly Expressed in a Certaine acco.t hereunto annexed the said John then & there to witt the day year & place afd within the Jurisdiction afd upon himselfe did assume and to the said James then and there did faithfully promise that he the said John so much Curr.t money of maryland as he the said James for his said services did Reasonably deserve and the Medicines and Unquents afd at the time of the sale and delivery afd were reasonably worth to the said James when he should be afterwards thereunto requested he would well & faithfully pay & Content and the afd James in fact saith that he for his services afd doth reasonably deserve to have of the said John the sum of three pounds six shillings and Eight pence and that the Medicines and unquents at the time of the sale and delivery afd were Reasonably worth the sum of seven pounds two Shillings Like money which two Last mentioned Sums in the whole do amount to tenn pounds Eight Shillings and Eight pence money afd of which the afd John the afd tenth day of February in the Year afd at the place afd within the Jurisdiction afd had Notice Nevertheless the said John his severall promisses and assumptions afd in form afd made Little regarding but plotting and fraudulently Intending the said Jurors in that part Craftilly and Subtilly to deceive and defraud the said severall sumes of Money to the said James as yett he hath not paid or to him for the same in any wise Contented altho' the same to do the said John by the same James on the Eleventh day of February in the year afd & often afterwards at ye parish & County afd within the Jurisdiction afd he was requested but ye same to him (hitherto) |
