166 seven hundred & twenty three Come again Plft and deft by their attorneys afd and pray of the said deft by his said attorney prays further Leave to Imparle hereunto untill the next Court and he hath it and the same day is given tot he plft also Att which said next Court to witt the twentieth day of August ann Dom one thousand seven hundred & twenty three Come again as well the said plft as the said deft by the ^their^ said def attorneys and ye said deft by his said attorney prays further Leave to Imparle hereunto untill the next Court and he hath it & the same day is Given to the plft also Att which said next Court to witt the Ninteenth day of November ann Dom one thousand seven hundred & twenty three Come again as well the said Plft as the said deft by their attorneys afd and ^the said^ deft by his said attorney prays further Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the plft also Att which said next Court to witt the seventeenth day of march Ann Dom One thousand seven hundred and twenty three Come again as well the said plft by his attorney afd as the said deft by his attorney afd and ye said deft by his said attorney as before defends the force & Injury when &c and saith that the afd Patrick Condemnation of the premisses so as afd attached ought not to have becaus he hath not nor at the time of Laying the attachm.t afd in his hands had or at any time since hath had any goods Chattells Rights or Creditts of the afd Timothy Bloodworth in his hands and this he is ready to verifie wherefore he prays Judgm.t if the afd Patrick Condemnation of the premisses so as afd attached against him to have Ought &c Dashiell P Deft Whereupon the said John Hitch Garnishe as afd by his attorney prays that the afd Patrick Simpson to his plea afd may answer Butt the Said Patrick altho' Solemnly Called Cometh not nor to the plea of the afd deft answereth now is his writt afd further prosecuted against the same deft Therefore it Considered by the Justices here the seventeenth day of march ann Dom One thousand seven hundred and twenty three afd that the sad Patrick Simpson take nothing by his writt afd but that he and his pledges of Prosecuting that is John Doe & Richard Roe be in mercy &c and that the said John Hitch goe thereof without and also it is Considered by the Justices here that the said John Hitch Recover against the said Patrick Simpson the sum of Two hundred & Twenty 222 Two pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his defence in this Behalfe Laid Out and Expended according to the form of the Statute thereof Lately made and provided & that the said John Hitch have thereof his Exn
Bloodworth of Somersett County if they shall be found in your Bailywick to the value of seventy two pounds twelve shillings debt and Interest and One thousand pounds of tobacco Costs of Suite and when you have the same attached or any part thereof the same in your Custody safe Keep so that (you) |
