165 by the Justices here the same day and Year Last mentioned that the said Robert Martin Recover ag.t the said John Sharp as well the sum of four hundred & sixty pounds of tobacco his damages afd in form Cost afd Confessed as also the sum of three hundred & fourteen pounds of tobacco (314) by the Court here adjudged unto him for his Costs and Charges by him about his suite in this behalfe Laid out & Expended and ye Deft in mercy &c
debt and Interest and one thousand pounds of tobacco Costs of Suite and when you have the same attached or any Part thereof the same in your Custody Safe Keep so that you have the same before the Justices of our County Court to be held at Dividing Creek the third tuesday of March next then & there to be Condemned according to act of assembly to and for the use of a Certain Patrick Simpson unless the said Timothy Bloodworth by himselfe or Lawfull attorney shall appear and answer unto the said Patrick Simpson of a plea that he render unto him one hundred thirty four pounds thirteen shillings Curr.t money which to him he Owes and Unjustly detaines &c according to Law and that by good & Lawfull men of your Bailywick you make Known unto the person or persons in whose hands you shall make the same attachm.t that he she or they be & appear before the Justices of our Said County Court to be held as afd to shew Caus if any they have why the same goods Chattells Rights or Creditts so attached in his her or their hands Ought not to be Condemned according to Law if to him her or them it shall seem mete and how you shall Execute this writt that you make Known to the Justices of our Said Court at the day and place afd and have you then and there this Writt Wittness Charles Ballard Gentl: Chief Justice of Our Said Court this twenty third day of November in the seventh year of our Dominion &c Alexd Hall Cler Anno Dom 1723 (Allen) Att which said third tuesday of march to witt the Ninteenth day of the same month ann Dom one thousand seven hundred & twenty two Being the day of the return of the said Writt Comes the said Patrick Simpson by his attorney afd and the sherr of Somersett County to whom the foregoeing writt was directed Likewise Comes and makes return thereof to the Court here Endorst in these words vizt To the worshipfull Justices within Mentioned I humbly Certifie that I have attached in the Hands of Jno Hitch the Sum of Nine Shillings & two pence as the rights & Creditts of Timothy Bloodworth and I further Certifie that I have given Notice unto the said Jno Hitch that he be & appear to shew Cause &c before John Doe & Richard Roe good & Lawfull men of my Bailywick so answers Jos MccClester sher And the said John Hitch by George Dashiel his attorney Comes & defends the force & Injury when &c and prays Leave to Imparle hereunto untill the next Court & he hath it and the same day is given to the plft also Att which said next Court to witt the Eighteenth day of June ann Dom one thousand (seven) |
