154 in the Eighth Year of Our Dominion &c ann Dom 1723 Thomas Hayward Clk on the Back of the foregoeing Commission it was thus Endorst viz.t These are to Certifie that Capt John Tunstall Capt William Planner and M.r Ephraim Willson ^Came^ before me the Subscriber one of his Lordships Justices for the peace for Somersett County and took their Oaths on the holy Evangelist of almighty that they would truly duly and Impartially Examine all Such Evidences as should be brought before them Concerning the Bounds of a Certain tract of Land Called Chance as part of assembly in that Case made and provided as Wittness my hand this fourth day of January ann Dom 1723/4 W.m Stoughton The deposition of Richard Chambers Sen aged Eighty Years or there abouts relateing to the first Bounder of a tract of Land surveyed for James Price Called Oxhead which also appears to be by Capt John King's deed the first Bounder of a tract of Land Called Chance this deponant being sworn according to the direction of an act of assembly made at the City of annapolis the 23d day of September Last declares that Cap.t John King deceas't desired this deponant to goe and se the above mentioned tract of Land Called Ox head and went with him to a white Oake standing on a part of ^high^ Land near a holly bush trimed up this day a Little to the Eastward of an antient Road now stopt by the Mill Dam that Came a Cross trading Branch or Kings Branch opposite to a point on the south side of the said Branch on which the road Entered the same Branch about five hundred yards along the Banck of the Branch above the ^now^ Mill Dam and New Church being the first deep sharp point that makes in on the North Side of of the afd Branch above the said Mill which said white oake afd the above Named Capt John King deceast above fifty four years agoe shewed this deponant as the first Bounder of Oxhead abovesaid bond of James Price bought of the afd James Price and further saith not as wittness my hand this 28.th day of Janry 1723/4 Richard Chambers By vertue of a Commission to us directed bearing Date the 23d day of Nov.r 1723 by the Justices of Somersett County Court psuant to the above mentioned at of assembly we the subscribers being sworn according to the direction of that act as appears but that act Endorsmt on the said Commission haveing given the due Notice the Law requires in such Cases requires went on the spott mentioned in the above deposition and there did take the abovesaid Richard Chambers solemn oath on the holy Evangelist of almighty God to the truth of what is therein Contained taken before us this 28.th day of Janry 1723/4 W.m Planner, Ephraim Willson, Jno Tunstall Jurat William Stoughton that he the Deponant with Coll Charles Ballard Being two of his Lordships Justices of the peace for Somersett County in ye Province of Maryland Being requested by Cap.t John King that we would Come to ye Land of him ye said Thing to Take ye Depositions of Sundry Evidences Concerning ye first Bounder of a Certain Tract of Land Called Chance Begin being In Dispute Between him ye said Capt John King and his Brother Mr Upshur King alledging as reason to Induce us to Come and Take ye said Deposition that while they Two Brothers Lived they would not fall out about ye said Bounder But their Childeren not Being so Nearely Related Might and while he had ye Opportunity he though his Duty to header what Disputes Might happen in time to Come when the Evidences were Dead Whereupon Coll Charles Ballard and I the Depn.t sometime in Novr 1722) according to ye best of My Rem^e^mbrance) Repaired |
