153 four pounds sixteen shillings and five pence to the said Archibald he hath paid and satisfied yett as to fourteen pounds Eight Shillings and One penny Residue of the afd twenty Eight four pounds Sixteen Shillings and five pence the said John his promise and assumption afd in form afd made Little Regarding but minding and fraudulently Intending the same Archibald in this part Craftilly and Subtilly to deceive and defraud the afd fourteen pounds Eight shillings & One penny or any part thereof unto the same Archibald hath not paid or in any sort Contented altho' to do the same the afd John afterwards to witt the first day of may in the year of Our Lord God seventeen hundred & twenty two and often afterwards at the County afd within the Jurisdiction afd by the afd Archibald he was requested but that unto him hitherto to pay or in any Sort to Content altogether hath refused and still doth refuse to the damage of the said Archibald of twenty Eight pounds sixteen shillings and One penny Lawfull money of america afd and thereupon he Bringeth Suite &c Allen P Qrte Pledgs dep Jno Doe R Roe 1720 D.r John Caldwell Jun.r to Arch.a Smith Cr
And the Said John Caldwell Junr by Levin Gale his attorney his attorney Comes and defends the force and Injury when &c and prays Leave to Imparl here unto untill the next Court and he hath it and the same day is given to the plft also Att which said next Court to witt the seventeenth day of March ann Dom One thousand seven hundred and twenty three Come again as (well) |
