Att which said third tuesday of march to witt the seventeenth day of the same month ann Dom one thousand seven hundred and twenty three being the day of the return of the said Writt Cometh the said Richard Holland by his attorney afd and the sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh & maketh return thereof to the Court here Endorst in these words following Nonest Inventus Decln Left p Jos: MccClester Sher vizt Whereupon the said Richard Holland by his attorney afd prays that forasmuch as he has Complyed with the Laws in Order to an attachm.t he may have Judgm.t against the said Thomas Brown for his damages afd by way of attachm.t according to act of assembly &c whereupon for that it seems to the Court here that the said Richard Holland has Complyed with the Law as alledged; Therefore it is Considered by the Justices here the seventeenth day of March ann Dom One thousand seven hundred and twenty three afd that the said Richard Holland Recover against the said Thomas Brown as well the sum of four hundred sixteen & a half pounds of tobacco his damages by Occasion of the premisses afd as all Costs and Charges by the said Plft Laid Out and Expended about his suite by way of attachm.t against the goods Chattells rights or Creditts of the said Thomas Brown according to act of assembly in such Case made and provided &c
seven hundred and twenty one at Somersett County and within the Jurisdiction of this Court was Indebted unto the afd Archibald in the sum of twenty four pounds sixteen shillings and five pence Lawfull money of america for divers goods wares and merchandizes by the same Archibald unto the afd John at the Especial Instance & request of the same John before that time sold and delivered as by an acco.t thereof here in Court Ready to be produced may appear and so thereof being Indebted the afd John afterwards to witt the same second day of November in the year afd at the County afd and within the Jurisdiction afd in Consideration thereof upon himselfe assumed and unto the afd Archibald then and there faithfully did promise that he the afd John the same twenty four pounds sixteen shillings and five pence money afd unto the same archibald when thereof afterwards he should be required well & faithfully would pay and Content and altho' the afd John ten pounds Eight shillings and four pence percell of the afd twenty (four) |
