                             March Court        1723            151
    Whereupon the said Timothy Atkinson by Francis allen his attorney appears & prays that the said Charles
Gresham may give security for Costs in Case Nonsuite be obtained against him the plea afd which is
by the Court Granted   Thereupon W.m Tazwell & Joseph MccClester Gentl Present here in Court
undertakes for the said Charles Gresham that in Case be Nonsuited in the plea afd or otherwise Legally
Cust that then the said Charles Gresham shall pay the Condemnation of the Court and all Costs accrueing
thereon to the said Timothy Atkinson or that they the said W.m Tazwell & Joseph MccClester will doe
it for him Thereupon the said Timothy Atkinson by his attorney afd appears & Imparls untill next
Court &c

 Somersett County fs:  John Trewitt Late of Allhollows parish in the County afd Planter
was attached to answer unto Thomas Dashiell of a plea of trespass upon the Case &c
    And whereupon the said Thomas by Levin Gale his attorney Complaines that whereas
                               the afd John the      day of                  on thousand seven hundred and
          at the parish afd within the Jurisdiction of this Court was Indebted unto the afd Thomas fifteen hundred
    and thirty seven pounds of tobacco for sherr.s dues Levies and forbearance thereon as by acco.t herewith filed
    in Court produced may more fully appear and so thereof being Indicted the said John in Consideration thereof
    the day and year afd at the place afd within the afd Jurisdiction upon himselfe assumed and to the said
    Thomas then and there faithfully promised that he when afterwards he should be thereunto requested to the
    afd Thomas the afd sum of fifteen hundred and thirty seven pounds of tobacco he would well and faithfully
    Content and pay Nevertheless the afd John his promise and assumption afd in form afd made Little regarding
    but plotting and fraudulently Intending the said Thomas in that part to defraud and deceive the afd sum
    of fifteen hundred and thirty seven pounds of tobacco to the afd Thomas (altho' thereunto requested the tenth
    day of may One thousand seven hundred and twenty two at the parish afd within the afd Jurisdiction & often
    afterwards) hath not paid nor him for it in any ways Contended but he the same hitherto to doe hath altogether
    refused and still doth Refuse whereby the said Thomas says he is the worse and hath damage to
    the value of three thousand pounds of tobacco & thereof he brings this suite &c
