of the same Parish and County Planter the twenty Eighth day of December one thousand seven hundred & twenty there with force and armes at Stepney ^Parish^ afd in the County afd within the Jurisdiction of this Court four unmarked swine of the price of thirty shillings Curr.t money of Maryland then & there being found then & there feloniously did Kill Steall take and Carry away against the Peace for our Said Lord proprietary his good rule & Dignity and also against the form of the act of assembly in such Case made & provided &c L Gale P Dom Propr There Command is Given to the Sherr of Somersett County that he should take the said William White and Benja Nesam if &c to answer &c And now hereafterwards to witt the same day and year Comes the said Willm White and Benja Nesam and being by the Sherr sett to the Barr (Indictmt read) is thereupon Instantly demanded how they would acquitt themselves of the premisses afd as by the Indictm.t above Imposed upon them say that of the premisses afd as by the Indictm.t in manner & form is supposed upon them they are no way Guilty thereof and for tryall thereof they putt themselves upon the Country & Levin Gale who for his said Lordship in their behalfe prosecuteth Likewise Thereupon Command is given to the Sherr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who neither &c to recognize &c because as well &c of which said Preceipt the said Sherr to witt Joseph MccClester Gentl: Now here at this day to witt the same day & year makes return that he has here ready twelve &c as by his said preceipt he was Commanded and the Jurors therein Impannelled being Called Came to witt Thomas Peall, John Dennis Sen John White Marumsco William Holland Isaac Williams John Beavins Lazarus Maddux Pocomoke David Hazzard, John Patrick Jun Adam Spence Sen Edmond Hough and William Mills who being duly Elected tryed & sworn upon their Oath do say that the said Will.m White and Benjamin White Nesum are not Guilty of the Premisses as by the Indictmt above is Imposed upon them &c Wherefore it is Considered by the Justices here that the ^his^ said Lordship the right honourable the Lord proprietary take nothing by the Indictmt afd by that the said William White and Benjamin Nesum go thereof without day acquitt &c Whereupon the said Benj.a Esom and William White are discharged from the Indictmt afd they giveing Security to pay the severall Officers their fees due by occasion of the premisses thereupon Joseph MccClester of Somersett County Gentl present here in Court undertakes for the said William White & Benja Esom & acknowledged himselfe to owe & stand Justly Indebted unto his Lordship the Lord proprietary in the sum of ten pounds Curr.t money to be Levied on his Body Goods or Chattells Lands or tenements for the use of ^the^ said Officers in Case he doth not pay & satisfie unto the Severall Officers their Fees due by action of the premisses afd &c |
