141 Read) is Instantly demanded how he would acquitt himselfe of the premisses afd above Imposed upon him says that of the premisses afd he is guilty thereof & submitts to the mercy of the Court but hath not wherewithall to pay his fine for the fact afd Wherefore it is Considered by the Justices here that the said John Sayler be whipt with fifteen Lashes on the Bear back well Laid on untill the Blood appear and thereupon as to the Corporeall Punishm.t afd Command is given to the Sherr of Somersett County that he doe thereof Immediate Execution according to the Judgm.t afd rendered by whiping the afd John Sayler at the Publick whiping post with fifteen Lashes on the Bear Back well Laid on untill the blood appear afterwards in the same Court the Sherr ^returns^ that he has done the Execution of the Judgm.t afd as to the Corporall Punishm.t afd he was Commanded Whereupon it's Ordered by the Court that the said John Sayler serve his said Master Jeffery Long three full months to Commence at the Expiration of his servitude it being ^adjudged^ for full satisfaction for ^one halfe of^ the damage trouble & Loss of time that the said Long was at in the time of the afd Katherine Ryne's Child bearing & Nursing of the same Child &c Likewise Its Ordered by the Court that the said Jefferry Long give security to return the said John Sailer to the County Court or the Sherr of the County at the Expiration of his Servitude to reemburst to the County the severall Officers their fees that accrued by action of the premisses &c Thereupon the said Jeffery Long being ^present^ acknowledged himselfe to owe & stand Justly Indebted unto his Lordship the Lord proprietary his heirs & successors in the sum of ten pounds Curr.t money to be Levied on his body Goods or Chattles Lands or tenements &c In Case the said Jeffery Long doe not return the said John Sayler to the County Court or the Sherr of the County at the Expiration of his servitude to reemburst to the County the severall officers their fees due by action of the premisses afd &c
themselves to be Indebted to his Lordship Each in the sum of ten pounds Curr.t money due to be Levied on their goods and Chattells Lands or tenements for the Use of his said Lordship &c The Condition of the above recognizance is such that if Richard Driskill do make his personall appearance before the Justices of Somersett County Court to be held at Dividing Creek the third tuesday of march next to answer unto all such things as shall be Objected against him by Hannah Fords on behalfe of his said Lordship and stay and abide the Judgm.t of the Said Court then this recognizance to be void Else to remain in force & vertue in Law Jno Handy Whereupon the said Richard Driskill in his own proper person appears and is discharged from the recognizance abovesaid Thereupon the Richard Driskill is ordered to give New recognizance for his good Beheaviour and appearance at Next Court Whereupon the said Richard Driskill together with Moses Driskill his security both present in Court acknowledged themselves to owe and stand Justly Indebted unto his said Lordship the Lord proprietary in the sum of fifty ^fifteen^ pounds Currant (Money) |
