14 Therefore it is Considered by the Justices here the Nineteenth day of March ann Dom one ' thousand seven hundred and twenty two afd that the said Robert Martin Recover against the said William Gilchrist and Thomas Brown as well the sum of four pounds three shill and four pence Currt mony and three hundred forty Eight pounds of tobo his damages by occasion of the Premises afd as all Costs and Charges by the said Plft Laid Out and Expended about his suite by way of attachm.t (256) against ye goods and Chattles rights or Creditts of the said Willm Gilchrist and Thomas Brown according to act of assembly in that Case made and Provided &c
and avalon Lord Baron of Baltemore &c To Our Justices of Sommersett County Court Greeting Whereas a Certain Action of Debt for the full and Just Sum of Five thousand four hundred and Eighty pounds of good sound merchantable tobacco and Cask Between John Scott and Jane Pitman his wife Exx of the Last will and testam.t of M.r Peter Dent dec.d Plfts and William Stevens Howard and Thomas Howard adm.rs of the Last will and testament of Edmond Howard late of Charles County in the Province of Maryland dec.d defts lately depending Before you wherein the said William Stevens Howard and Thomas Howard Brought their suitt of Error to Correct the Errors in the same Judgm.t returnable Before the Justices of Our Provinciall Court and in Pursuance to the writt of Error afd a transcript of the ^process and^ Proceedings therein was transmitted But for as much as the Justices of Our Said Provinciall Court are not fully satisfied that there is a Sufficient record sent in the action afd but the record thereof Diminished Wee therefore Command you that without delay a full transcript of the Whole Proceeding therein you Cause to be transmitted to Our Justices of Our Provinciall Court to be held at annapolis the second tuesday of aprill next without any Diminuition whatsoever to ^the^ End speedy Justice may be done in ye Premisses according to Law whereof you are in noe wise to faile and send you then there this Writt Wittness Samuel Young Esqr Chief Justice of Our Said Provinciall Court ye 25.th day of September in the seventh Year of Our dominion &.c Ann Dom: 1722 (D: Dulany) Vachel Denton Clk Which being read and heard it is Ordered by the Court here that a full transcript of the Proceedings be made and sent according to the tenour and Command of the Writt afd in Complyance to which Order ye same is here Certifyed P Thomas Hayward Cl Cur Com Som |
