138 Att a Court of the right honourable Charles absolute Lord and proprietary of the provinces of Maryland &c held at Dividing Creek in Somersett County by his Lordships Commissioners & Justices of the peace ^the third tuesday of march being^ the seventeenth day of the said ^same month^ in the Ninth Year of his said Lordships dominion &c ann Dom 1723 Present
Proclamation being made in Usuall form & the Sherr of Somersett County to witt Joseph MccClester Gentleman being Called to make return of the pannell of the Grand Jurors return's the same which Jurors are as followeth viz.t Adam Heatch, William Richardson, Sturgis Dickson, Robert Hodge, John Paty, George Jarman, Thomas Poynter, Samuel Derixson, Solomon Colebourn William Adams, John Stephens, Jefery Long, John Cheesman, Chrispin Price, Richard Nicholson Jun; John Jarman, John Houston, John Bratton, Thomas DIckson Manigh, William Piper, Lewis Disharoon & Robert Hall who being severally Called appeared and were sworn and Charged and sent out to Consider &c who soon after appeared and Present to the Court here the following bills of Indictm.t being Content that the Court should amend form altering noe manner of substance in them viz.t Indictm.t against John Stark, John Newbold Benj.a Tull Rebecca Gillett, William White John Esome John Sayler, Mary Jones, Mitchel Dashiel Jane Duckett, Isabell Husk James Driskill, Edward Peacock Thomas Benston William Robinson, William Miles Thomas Brown & Mary Bolitha, thereupon the grand Jurors are accordingly discharged & ordered that they be allowed the sume of five hundred pounds of tobo to be paid next Levey Court and against the severall Persons afd Indicted it is Ordered that Capias Issue returnable to next Court &c
Upon reading the petition and the premisses naturally Considered It's thereupon Ordered by the Court that Cap.t John Jones and William Stoughton Esq.r agree with some person to take Care of the said Priscilla Jervis and to allow her a sufficiency and they shall be allowed for the same at the Laying of the County Levey next & they the said John Jones & William Stoughton to be al make their report to next Court &c A Letter from Daniel Dulany Esq.r Prosecutor Generall of his Lordships Please in the province of maryland to this County Court of Somersett ^being Produced^ for to appoint a fitt person to act as Prosecutor of his Lordships Pleas in the said County for as much as William Tazewell the former prosecutor in the County afd Resides in vergenia and refuses to reside in the Province and declines the same &c thereupon the Court are all of Opinion that Levin Gale of Somersett County Gentl: is a fitt person and that he act as prosecutor in the County afd and prosecute his Lordships pleas untill such time as a Commission be produced from the said Dulany for the Prosecutors place afd &c Thereupon the said Levin Gale present here in Court made Oath that he would act as Prosecutor in the County afd to the Best of his Skill & Knowledge &c |
