134 the Justices here the same day & year Last mentioned that the said Samuel Brought recover against the said Thomas Layfield as well the sum of One thousand Nine hundred and Eight pounds of tobacco his (248) debt afd as also the sum of Two hundred and Eighty four pounds of tobacco by the Court here adjudged unto him for his Costs and damages sustained by Occasion of the detaining of the same debt to him to be adjudged & ye Deft in mercy &c
Speciall Bail to ye action afd Thereupon the said John Caldwell Jun at the prayer of the plfts attorney is adjudged to give in his proper person undertakes for the said John Caldwell Jun that in Case the said Archabald Smith shall Recover Judgmt in the plea afd against the said John Caldwell Jun or that the said John Caldwell Jun shall be therein Convect that then he the said John Caldwell Jun shall pay the Condemnation of the Court thereupon or rend his Body to the Custody of the sherr of Somersett County in satisfaction thereof or that he the said John Caldwell Sen will doe it for him thereupon the said John Caldwell Jun appears by Levin Gale his attorney & Imparls till next Court &c Maryland fs: Know all men by these presents that Wee Joseph MccClester William Whittington and Hugh Porter of Somersett County in the province afd are holden & firmly Bound unto the right honourable Charles absolute Lord and proprietor of the province of maryland &c in the full sum and Just quantity of two hundred thousand pounds of good sound merchantable Leafe tobacco and Casque to be paid unto his said Lordship his heirs and successors to ye which paymt well and truely to be made & Done wee Bind Our Selves and Every us Our & Every of Our heirs Exrs and adrs Joyntly & severally for the whole & in the whole firmly by these presents sealled with our seals and dated the twenty third day of Novem in the Eighth year of his Lordships Dominion &c ann Dom 1723 The Condition of this ^above^ obligation is such that if the above Bound Joseph MccClester do well & truely serve the right honourable the Lord proprietarie of this province his heirs & successors in the Office of high Sherr of the County of Somersett within ye province afd and in all things well & faithfully Execute the same Office and also shall render unto his said Lordship and Other his Officers a true faithfull & perfect account of all & singular his sd majestys rights and dues to his Officers a true & Just accompt of their fees that he shall or may be Intrusted with by his said Majestys Governour and Other his Officers within this province to receive & Collect ^and^ his account had his said majestys his heirs and successors and to his and there Governour here for the time being for the fines & Forfeitures and other dues belonging to his said Majestys Governour as also his acco.t of all fees dues & sums of money or tobacco due to any the Good people within this province for any sum or sumes of money or tobacco due wherewith the said sherr ^shall^ be Entrusted dureing the time of his Sherivalty for the present or to such of them as he shall request require the same shall pass & render by the tenth day of may next Ensueing the date (thereof) |
