And the said Thomas Layfield in his Own proper person Comes & defends the force & Injury when &c  and prays
Leave to Imparle hereunto untill the next Court and he hath it and the same day is Given to the plft
also               Att which said next Court to witt the Ninteenth day of November ann Dom One thousand seven
hundred and twenty three Comes again the said Robert Martin by his attorney afd and prays that the said
Thomas Layfield to his declaration in the plea afd may answer but the Said Thomas Layfield altho'
solemnly Called Comes not but makes default &c whereby the said plft remains against the said deft
wholly undefended
             But because it is unknown or to his Lordships Justices here what damages the said Robert Martin
hath Sustained by Occasion of the premisses afd          thereupon the Justices here at the prayer of the
afd Robert and according to act of assembly do assess the damages of the afd Robert by Occasion of
the premisses afd beyond his Costs and Charges to two thousand five hundred & sixty Eight pounds of
tobacco                                    Therefore it is Considered by the Justices here the Ninteenth day of Novem
Ann Dom One thousand seven hundred and twenty three afd that the said Robert Martin Recover against
the said Thomas Layfeild as well the sum of two thousand five hundred & sixty Eight pounds of
tobacco Certain damages afd in form afd assessed as also the sume of Three hundred & Sixty Nine
(369)            pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him
about his suite in this Behalfe Laid Out & Expended & ye Deft in Mercy &c

planter al.s dictus James Trehain of the Parish of Coventry in the County of Somersett
                                  in maryland was sumoned to answer unto George Willson of Saint Stephens parish
       of King and Queen County in Vergenia of a plea that he render unto him seventy pounds of Good & Lawfull
       Curr.t mony of maryland which to him he Owes and Unjustly detaines &c
                   And whereupon the said George by Francis Allen his attorney saith that whereas the said James the
       twenty seven day of November in the Year of Our Lord One thousand Seven hundred & twenty One at ye
       parish and County afd within the Jurisdiction of this Court by his Certain Writeing Obligatory which the said
       year did acknowledge himselfe to be Bound unto the said George in the afd seventy pounds of good & Lawfull
       Currant money of maryland to be paid unto the said George when he should be thereunto required
       Yett ye said James tho' often required the said seventy pounds money afd ^to^ the afd George he hath not
       Rendered but ye same to him hitherto to render hath denyed and still doth deny and Unjustly detain to
       ye Damage of ye said George of forty pounds money afd and thereupon he Brings suite &c

          Whereupon the said James Trehain by Levin Gale his attorney Comes & Defends the force & Injury
       when &c Whereupon the dispute in this action is by the Court & Consent of the partys by their attorneys
       afd Refered to Robert King, John Jones, & George Dashiell and these word to of Somersett County
