       this he putts himselfe upon the Country &c Levin Gale P Deft   Whereupon the said Richard Webb
by his attorney afd prays that the plea afd may be withdrawn for that he Cannot gainsay the plft his action afd
so as afd against him brought nor Can he say but that the said plft Ought to recover his damages by Occasion
of the premisses afd to the sum of one thousand and fifty three pounds of tobacco and Costs of Suite against
him which the said plft does not gainsay
                                        Therefore it is Considered by the Justices here the Ninteenth day of November ann
Dom One thousand seven hundred & twenty three afd that the said Robert Martin Recover against the said
Richard Webb as well the sum of One thousand & fifty three pounds of tobacco Certain damages afd in form afd
(250)   Confessed as also the sum of Two hundred & fifty                                                         pounds of tobacco
by the Court here adjudged unto him for his Costs and Charges by him about his suite in this Behalfe Laid Out & Expended
and the defend.t in mercy &c

 Somersett County fs    Thomas Layfield of Coventry parish in the County of Somersett Genl was attached
to answer unto Robert Martin of a plea of trespass upon the Case &c
        And whereupon the said Robert by Francis Allen his attorney Complaines that whereas the said Thomas
                the thirtieth day of October ann Dom one thousand seven hundred & twenty two at the parish & County afd within the
Jurisdiction of this Court was Indebted unto the Said Robert in two thousand Eight hundred Ninty and seven pounds of tobacco for
Levies Sheriffs fees and publick dues and forbearance thereupon to the said Robert then and there due owing & unpaid as by accot
thereunto annexed may in Court appear and being so thereof Indebted the said Thomas in Consideration thereof afterwards to witt
the say and year afd at the place afd in Consideration thereof upon himselfe did assume ^and^ to the said Robert then and there
faithfully did promise that he the said Thomas the afd two thousand Eight hundred Ninty & seven pounds of tobacco to the said Rob.t
when he should be afterwards thereunto requested he would well and faithfully pay and Content and altho' the said Thomas
three hundred twenty and Nine pounds of tobacco Pcell of the afd two thousand Eight hundred Ninty & Seven pounds of tobo
to the said Robert he hath paid and satisfied yett as to two thousand five hundred Sixty and Eight pounds of tobacco residue
of the afd two thousand Eighty hundred Ninty and Seven pounds of tobacco the said Thomas his promise and assumption
afd in form afd made Little Regarding but plotting and fraudulently Intending the Said Robert in that part Craftilly
and Subtilly to deceive and defraud the afd two thousand five hundred Sixty and Eight pounds of tobacco to the said Robert
he hath not paid or to him for the same in anywise Contented altho' the same to do the same Thomas by the said Robert on
the first day of December in the Year afd and often afterwards at the parish & City County afd within the Jurisdiction afd
of this Court he was thereunto requested but the same to him to pay or in anywise to Content hath refused and still doth refuse
and deny whereupon the said Robert saith he is worse and hath damage to the value of five thousand one hundred and
fifty six pounds of tobacco & thereupon he Brings Suite &c       Allen P Quer Pledges deft Jno Doe Richd Roe
