13 directed Like wise Comes and makes return thereof to the Court here Endorst in these words vizt Cep N. W. p Jos: MccChester sher Whereupon the said Thomas Dashiell by his attorney afd Prays that for as much as he has Complyed with the Laws in Order to an attachment he may have Judgmt against the said Anthony Moore for his debt afd by way of attachm.t according to act of assembly &.c Whereupon for that it seems to ye Court here that ye said Thomas Dashiell has Complyed with the Laws as alledged Therefore it is Considered by the Justices here the same day and year Last mentioned that the said Thomas Dashiells recover against the said Anthony Moor as well the sum of two thousand One hundred and Ninety two pounds of tobo his debt afd as all Costs and Charges by the Plft laid out (181) and Expended about his Suite by way of attachm.t against ye goods Chattles rights or Creditts of the said Anthony Moore according to act of assembly in Such Case made and Provided &c
third tuesday of March then next to answer unto Robert Martin of a plea of trespass upon the Case and that thereof he should not faile &c And whereupon the same Robert by francis Allen his attorney Complains that whereas the afd Wm and Thomas the third day of february in the Year of Our Lord God One thousand Seven hundred and twenty One at the afd Parish and County and within the Jurisdiction of this Court were Indebted unto the afd Robert in the sum of fifteen pounds twelve shill and three pence and Eighteen hundred ninety Eight pounds of tobacco as by an acco.t thereof herein Court ready to be produced may appear and so thereof being Indebted the afd W.m and Thomas afterwards to witt the same third day of february in the year afd at the County afd and within the Jurisdiction afd in Consideration thereof upon themselves did assume and unto the afd Robert then and there faithfully did Promise that they the afd W.m and Thomas the same fifteen pounds twelve shillings and three pence and Eighteen hundred and Ninety Eight pounds of tobacco unto the said Robert when thereof afterwards they should be required well and faithfully would pay and Content and altho' the afd William and Thomas Eleven pounds Eight shillings and Eleven pence and One thousand five hundred and fifty pounds of tob.o Percell of the afd fifteen pounds twelve shillings and three pence and Eighteen hundred and Ninety Eight pounds of tobacco to ye said Robert they have paid and satisfied Yett as to four pounds three shillings and four pence and three hundred forty Eight pounds of tobacco residue of the afd fifteen pounds twelve shillings and three pence and Eighteen hundred Ninety Eight pounds of tob.o the said W.m and Thomas their promise and assumption afd in form afd made little regarding but minding and fraudulently Intending the same Robert in this Part Craftelly and Subtelly to deceive and defraud the afd four pounds three shillings and four pence and three hundred forty Eight pounds of tobo or any part thereof unto ye same Robert they have not paid or in any Part Contented altho' to do (the) |
