129 was sommoned to answer unto Margarett Lady Baltemore widdow & Executrix of the Las will and testament of the Right honourable Charles Lord Baron of Baltemore &c Lately dec.d of a plea that he render unto her Eighteen hundred pounds of Good sound merchantable tobacco which from her he unjustly detaines &c And whereupon the said Margearett Lady Baltemore by Francis Allen her attorney Complaines that whereas the said Somersett the third day of february one thousand six hundred & Eighty seven at the parish & County afd within the Jurisdiction of this Court by his Certain Writeing Obligatory which the said Margarett Lady Baltemore with the seall of the said Somersett signed here into Court Brings the date whereof is the same day and and year did acknowledge himselfe to be Bound unto the said Right honourable Charles Lord Baron of Baltemore in his Life time in the afd Eighteen hundred pounds of tobacco to be paid unto the said Right honourable Charles Lord Baron of Baltemore when he should be thereunto required yett the said Somersett tho' often thereunto required the said Eighteen hundred pounds of tobacco to the said Right honourable Charles Lord Baron of Baltemore &c in his Lifetime or to the afd Margarett Lady Baltemore after the decease of the said Right honourable Charles Lord of Baltemore &c hath not rendered but the same to the right honourable Charles Lord Baron of Baltemore &c in his Lifetime or to the afd Margarett Lady Baltemore after the decease of the said Right honourable Charles Lord Baron of Baltemore &c to Render hath denyed and the same to the said Margarett Lady Baltemore to render still doth deny and unjustly detain to the retarding her in the Execution of the Last will and testament afd and to the damage of the said Marg.tt Lady Baltemore of three thousand pounds of tobacco & thereupon she Brings suite and Brings into COurt have her Letters Testamentary by which &c Allen P Quer Pledgs deft Jno Doe & richd Roe And the said Somersett Dickenson by Gorge Dashiell his attorney Comes and defends the force and Injury when &c and prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the plft also Att which said next Court to witt the twentieth day of November ann Dom one thousand seven hundred and Eighteen ^twenty two^ Comes againe as well the said plft as the said deft by their attorneys afd and the said deft by his said attorney as before prays further Leave to Imparle hereunto untill the next Court and he hath it & the same day is Given to the plft also Att which the said next Court to witt the ninteenth day of the same month March ann Dom One thousand seven hundred and twenty two Comes again as well the said plft as the said deft by their attorneys afd & the said deft by his said attorney prays further Leave to Imparle hereunto untill the next Court and he hat it and ye same day is Given to ye plft also Att which said next Court to witt the Eighteenth day of June ann Dom One thousand seven hundred and twenty three Comes again as well the said plft As the said deft by their attorney afd and the said deft by his said attorney prays further Leave to Imparle hereunto untill the next Court and he hath it & the same day is Given to the plft also Att which said next Court to Witt the twentieth day of august ann Dom One thousand seven hundred and twenty three Comes again as well the said plft as ye said deft by their attorneys afd & ye said deft by his said attorney prays further Leave to Imparle hereunto untill ye Next Court and he hath it and the (same) |
