129 the prayer of the plfts attorney is adjudged to give Speciall Bayl to the action afd thereupon a Certain Adam Hitch of Somersett County Gent: Present here in Court undertakes for the said Edward Short that in Case the said James Bowcher shall recover Judgmt in the plea afd against the said Edward Short or that the said Edward Short shall be therein Convict that then he the said Edward Short shall pay the Condemnation of the Court thereupon or render his Body to the Custody of the sherr of Somerset County in Satisfaction thereof or that he the said Adam Hitch will doe it for him thereupon the said Edward Short by Francis Allen his attorney appears & Imparles &c
Justices of his Lordship County Court of Somersett to be held at Dividing Creek in Somersett County the third tuesday of November next to answer unto Christopher Nutter of a plea that they render unto him the Just quantity of two pounds twelve shillings and ten pence which to him they Owe & unjustly detaine &c and that thereof then he should not fail &c Att which said third tuesday of November to witt the Ninteenth day of the same month ann Dom one thousand seven hundred and twenty three Being the day of the return of the said Writt Cometh the said Christopher Nutter by George Dashiell his attorney and the sherr of to whom the foregoeing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorst in these words following viz.t Cepi Corpus P Jos: MccClester Sherr Whereupon the said Richard Tiler and William White in their Own proper persons Comes & Defends the force & Injury when &c and says that they Cannot Gainsay the plft the action afd nor Can they say but that the said Christopher Nutter Debt writeing Obligatory afd is their act and deed and that the debt there in Mentioned is Yett due & unsatisfied wherefore the said plft prays Judgmt for his debt afd and his Costs and damages sustained by occasion of the same Debt to him to be adjudged Therefore it is Considered by the Justices here the Ninteenth day of November ann Dom one thousand seven hundred & twenty three afd that the said Christopher Nutter Recover against the said Richard Tiler ^and William White^ as well the sum of two pounds Eight shillings ^and ten pence^ his debt afd as also the 296 sume of Two hundred & Ninty Six pounds of tobacco by the Court here adjudged unto him for his Costs and damages sustained by Occasion of the detaineing of the same debt to him to be adjudged &c
