Court of Somersett to witt on the Eighteenth day of Aprill in the seventh year of Our Dominion &c ann Dom One thousand seven hundred and twenty two Before the worshipfull Charles Ballard and his associates Justices of our said Court at Dividing Creek and by Consideration of our said Court Recovered against a Certain William Pepper as well the sum of one thousand three hundred and sixty One pounds of tobacco a Certain Debt as also the sume of one hundred and Ninety pounds of tobacco Costs of Suite whereof he is Convect as by the records and process thereof in Our Said Court remaining manifestly appears and for as much as Execution remaineth thereupon as yett to be done and Because wee will that those things which in Our Said Court are rightly done and acknowledged should be Brought to a due Execution Command you that by Good & Lawfull men of your Bailiwick you make Known unto the said William Pepper that he be & appear before the Justices of Our Said County Court of Somersett to be held at Dividing Creek in Somersett County afd the third tuesday of August next to Shew Cause if any thing for himselfe he hath or Knoweth to say why the said Benjamin Wailes his Execution of the Judgm.t afd ag.t him the said William Pepper according to the form of the recovery afd he ought not to have if to him it shall seem mete and have you then and there the Names of those by whom you make the same Known and this writt Wittness Charles Ballard Gentl: Chief Justice of Our Said Court the 20.th day of August ^June^ in the Eighth year of Our Dominion &c ann Dom 1723 (Fran: Allen) Thomas Hayward Clk Att which said third tuesday of August to witt the third tues ^twentieth^ day of August the same month being the day of the return ye same writt ann Dom One thousand seven hundred and twenty three being the do Comes the said Benjamin Wailes by his attorney afd and the sherr of Somersett County to whom the foregoeing writt was directed Likewis Cometh and maketh return thereof to the Court here Endorst in these words following vizt Nihill P Joseph MccClester sherr Therefore Command is againe Given to the Sherr of Somersett County that by Good &c he make Known unto the said William Pepper that he be & appear before the Justices of his Lordships County Court of to be held at Dividing Creek for the County of Somersett the third tuesday of Novem Next to shew Cause in form afd &c if &c and further &c the same day is Given to the the said Benjamin Wailes also Att which said third tuesday of November to witt the Ninteenth day of the same month ann Dom One thousand seven hundred and twenty three being the day of the return of the said Writt Cometh the said Benjamin Wailes by his attorney afd and the sherr of Somersett County to whom the foregoeing Writt was directed Likewise Cometh and maketh return thereof to the Court here Endorst viz.t Nihill P Jos: MccClester She Whereupon the said William Pepper altho' Solemnly Called Comes not nor Shews Cause why &c but makes (default) |
