Greeting we Command you that you Attach any the goods Chattles rights or Creditts of Arthur Hayman of Stepney parish in ye County of Somersett planter if they shall be found in your Bailywick to the value of seven pounds six shillings and nine ^pence^ pence hundred and six hundred pounds of tobacco and when you have the same so attached or any part thereof the same in your Custody safe Keep so that you have the same Before the Justices of our County Court to be held at Dividing Creek in Somersett County afd the third tuesday of November next then & there to be Condemned according to act of assembly to and for ye use of a Certain Patrick Simpson unless the said Arthur Hayman by himselfe or his attorney appear and answer unto the said Patrick Simpson in a plea of trespass upon the Case &c according to Law and that by good & Lawfull men of your Bailywick you make Known unto the person or persons in whose hands you make the same attachm.t that he she or they be and appear before the Justices of Our Said Court to be held as afd to shew Cause if any he she or they have why the same Goods Chattels rights or Creditts so attached in his her or their hands Ought not to be Condemned & Execution thereof had and shall Execute this writt that you make Known unto Our said Justices at the same day & place afd and have you then & there this writt wittness Charles Ballard Gentl: Chief Justice of Our Said Court the 24.th day of aug.t in the Eighth Year of Our Dominion &c ann Dom 1723 (F Allen) Thomas Hayward Clk Att which said third tuesday of November to witt the Ninteenth day of the same month ann Dom One thousand seven hundred and twenty three Being the day of the return of the said Writt Cometh the said Patrick Simpson by Francis Allen his attorney and the sherr of Somersett County to whom the foregoeing Writt was directed Likewise Cometh & make the return thereof to the Court here Endorst in these words following vizt To the worshipfull Justices within mentioned I humbly Certifie that by vertue of the within Writt to me directed I have attached in the hands of Arthur Haymand the sume of seven pounds six shillings and Nine pence & six hundred pounds of tobacco and further I Certifie that I have Given Notice to the said Arthur Hayman that he be & appear at the time & place within Contained to shew Cause &c before Hugh Porter and John Doe good and Lawfull men of my Bailiwick as by the within Writt I am Commanded so answers Jos: MccClester Sherr Whereupon the said Arthur Hayman altho' Solemnly Called to shew Cause why &c Comes not but makes default nor does any other person appear for him to Shew Cause to the Contrary &c Whereupon the said Patrick Simpson by his attorney afd prays that the sum of seven pounds six shillings and Nine pence and six hundred pounds of tobacco afd attached may be Condemned in the hands of the said Arthur Hayman for the use of the said Patrick Simpson &c Therefore it is Considered by the Justices here the Ninteenth day of November ann Dom One thousand seven hundred and twenty three that the afd sum of seven pounds six shillings and Nine pence & six hundred pounds of tob.o so as afd attached be Condemned in the hands of the said Arthur Hayman for the use of the said Patrick Simpson and that the said Patrick Simpson have thereof his Execution against the said Arthur Hayman according to act of assembly &c |
