1723 111 thereof hereunto annexed may in Court appear and being so thereof Indebted the said Prisilla whilst she was sole afterwards to witt the day and year afd at the place afd in Consideration of thereof upon herself did assume and to the said Robert then and there did faithfully promise that she the said Priscilla the said four hundred & forty three pounds of tobacco to the said Robert when she should be afterwards thereunto required she would well and faithfully pay and Content Nevertheless the afd Priscilla whilst she was sole and the afd Timothy and Priscilla after the Espousalls Between them Celebrated the promise and assumption of the afd Priscilla in form afd made Little regarding but plotting and fraudulently Intending the said Robert in that part Craftely and subtilly to deceive and defraud the afd four hundred and forty three pounds of tobacco or any part thereof to the said Robert have not paid nor Either of them hath paid or Contented altho' the same to doe the same Priscilla often whilst she was sole and the afd Timothy and Priscilla after the Espousals between them Celebrated afterwards to witt the thirtieth day of January ann Dom One thousand seven hundred and twenty two at the Parish and County afd within the Jurisdiction afd they were requested and Each of them were ^thereunto^ requested but the same to doe have refused and still do refuse and deny Whereupon the said Robert saith he is worse and ^hath^ Damage to the value of Eight hundred Eighty & Eight pounds of tobacco and thereupon he Brings suite &.c Allen P Qrte Pledges def Jno Doe R Roe Timothy Malcolm and Priscilla his wife Late Priscilla Messick Dr To her amount
force and Injury when &.c and pray Leave to Imparle hereunto untill the next Court and they have it and the same day is Given to the plft also Att which said Next Court to witt the Eighteenth day of the June ann Dom one thousand seven hundred and twenty three Comes againe as well the said Plft as the said deft by their attorneys afd and the said defend.ts by their said attorney pray further Leave to Imparle hereunto untill the next Court and they have it and the same days is given to the plft also Att which said next Court to witt the twentieth day of august ann Dom One thousand seven hundred and twenty three Comes again as well the said Plft as the said defts by their attorneys afd and the said defts by their said attorney as before defend the force and Injury when &.c and say that the afd Priscilla whilst she was sole did not assume upon her selfe in manner and form as the afd Robert hath against them above Complained and of this they putt themslves upon the Country Levin Gale P Defts & ye Plft in Like manner F Allen P Qrte Thereupon Command is Given the Sherr of Sommersett County that Immediately you he Cause to Come here twelve &.c by whom &.c who neither &.c to recognize &.c because as well &.c of which said Preceipt the said sherr to Witt Joseph Macclester Gent makes return that he has here ready twelve &.c as by his said preceipt he was Commanded and Nowhere afterwards to witt the same day and year Last mentioned Comes as well the said plft as the said defts by their attorneys afd and the Jurors of that Jury Impannelled being Called Likewise Came to witt John Elzey John Beavins, John Fleming, Jonathan Raymond, Charles Townsend, John Tull, John Gillett, Thomas Collins John Turvell John Williams Robert Mitchell adam Spence Junr who being duely Elected tryed and sworn (to) |
