when &.c and prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is Given to the plft also Att which said next Court to Witt the Eighteenth day of June ann Dom One thousand seven hundred and twenty three Comes again as well the said plft by his as the said deft by their attorneys afd and the said deft by his said attorney prays further Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the plft also Att which said next Court to witt the twentieth day of August ann Dom One thousand seven hundred and twenty three Comes again as well the said plft as the said deft by their attorneys afd and the said defend.t by his said attorney as before defends the force and Injury when &.c and says that he did not assume upon himselfe in manner and form as the afd robert hath above against him Complained and of this he puts himselfe upon the Country Levin Gale P Defte And ye Plft in Like manner Allen Whereupon the said Robert Martin altho' solemnly Called Comes not but makes default nor is his writt in the pleafd afd further Prosecuted against the said Timothy Malcolm &.c Therefore it is Considered by the Justices here the twentyeth day of august ann Dom One thousand seven hundred and twenty three that the said Robert Martin and his predges of Prosecuting that is John Doe and Richard Roe be in mercy &.c and that the said Timothy Malcolm goe thereof without day &.c and also it is Considered by the Justices here that the said Timothy Malcolm Recover against the (238) said Robert Martin the sume of Two hundred & thirty Eight pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his defence in this behalfe Laid Out and Expended according to the form of the statute Lately made and provided and that the said Timothy Malcolm have thereof his Execution &.c
whilst she was sole to witt the thirtieth day of November Ann Dom One thousand seven hundred and twenty two at the Parish and County afd within the Jurisdiction of this Court was Indebted unto the said Robert in four hundred forty and three pounds of tobacco for Levies Publick dues and forbearance thereupon to the said Robert before that time then and there doe owing and unpaid as by account (thereof) |
