Cort 1722 a Certain Dudley Beaks of Sommersett County Planter Present here in Court undertakes for the said John Stewart that in Case the said Robert Martin shall recover Judgm.t in the Plea afd against the said John Stewart or that the said John Stewart shall be therein Convict that then he the said John Stewart shall pay the Condemnation of the Court thereupon or render his Body to the Custody of the sherr of Somrsett County in satisfaction thereof or that he the Said Dudley Beak will do it for him Whereupon the said John Stewart in his Proper Person Comes and defends the force and Injury when &.c and says that he Cannot gainsay the Plft his action afd so as afd against him Brought nor Can he say but that ye said plft ought to recover his damages by occasion of the Premises afd to the sum of four hundred and sixty Pounds of tobo and Costs of Suite against him which the said Plft doth not gainsay &c Therefore it is Considered by the Justices here the Nineteenth day of march afd ann Dom one thousand seven hundred and twenty two that the said Robert Martin Recover against the said John Stewart as well the sum of four hundred and sixty pounds of tobo Certain Damages afd in form afd Confesed as also the sum of Two hundred & Eighty Seven Pounds of tobo by the Court here adjudged unto him for his Costs and Charges by him about his Suite in this behelfe Laid out and Expended and ye Deft in mercy &c memorand.m the foll accot should have been Entered at foott of the afd decln but omitted & entered
Court of Sommersett to be held at Dividing Creek the third tuesday of march then next to answer unto unto the right honrble Margarett Lady Baltemore Executrix of the last will and testam.t of the right honrble Charles Lord Baron of Baltemore Lately dec.d of a plea that he render unto her Six thousand pounds of good sound merchantable Leafe tobacco and Casque to Containe the Same which from her he Unjustly detains &c and that thereof he should not faile &c And Whereupon the said Margarett Lady Baltemore by francis Allen his attorney saith that whereas the afd William Layton the grand father decd whose heir the above Named William Layton decd was where he is the above named William Layton now living in his Life time to witt on the fourteenth day of may Ann Dom One thousand six hundred and Eighty Eight by his Certain Writeing Obligatory acknowledged himself to be Bound to the Right honrble Charles Lord Baron of Baltemore in his Life time in two thousand four hundred pounds of good sound merchantable tob.o of the afd six thousand pounds of good sound merchantable leafe tobacco and Caske to be paid unto the said Right honrble Charles Lord Baron of Baltemore when he should be thereunto required (and) |
