103 this province and Costs of Suite against him which the said plft doth not Gainsay &c Therefore it is Considered by the Justices here the twentieth day of August ann Dom One thousand seven hundred and twenty three that the said Joseph Gray recover against the said Nathaniel Horsey as well the sume of six pounds Current Money of this province Certain damages afd in form afd Confessed as also the sum of (245) Two hundred & forty five pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his suite in this Behalfe Laid Out and Expended and ye Deft in Mercy &c
of august then next to answer unto John Scott of a plea that he render unto him twenty six pounds six shillings & Eight pence Curr.t money of maryland which to him he Owes and unjustly detains &c and that thereof he should not faile &c And the said John Scott by Francis Allen his attorney declares against the said John Taylor in the plea afd as followeth vizt Somersett County fst John Taylor Jun.r of Coventry Parish in the County of Somersett planter al.s dict John Taylor Jun.r of the County of Somersett in the province of maryland was sumoned to answer unto John Scott of a plea that he render unto him twenty six pounds six shillings and Eight pence Curr.t money of Maryland which to him he ows and from him he unjustly detains &c And whereupon the said John Scott by Francis Allen his attorney saith that whereas the said John Taylor the twenty seventh day of January ann Dom One thousand seven hundred and Ninteen twenty at the Parish and County afd within the Jurisdiction of this Court by his Certain Writeing Obligatory which the said John Scott with the seall of the said John Taylor signed here into Court Brings the date whereof is the same day and year did acknowledge himselfe to be Bound unto the afd John Scott in the afd twenty six pounds six shillings and Eight pence Curr.t money of maryland to be paid unto the Said John Scott when he should be thereunto required yett the said John Taylor then Often required the said twenty six pounds six shillings and Eight pence to the said John Scott hath not rendered but the same to him hitherto to render hath damaged and still doth deny and unjustly detaine whereupon the said John Scott saith his is worse and hath damage to the value of tenn pounds Money afd and thereupon he Brings Suite &c P Allen P Qrte Pledgs def Jno Do R Ro Att which said third tuesday of august to witt the twentieth day of the same month ann Dom One thousand seven hundred and twenty three Being the day of the return of the said Writt Cometh the Said John Scott by his attorney afd and the Sherr of Somersett County to whom the foregoeing Writt was directed Likewise Cometh and maketh return thereof to the Court here Endorst in these words following vizt Cepi Corpus P me Joseph MccClester Sherr Whereupon the Said John Taylor in his Own proper person Cometh and defendeth the force and Injury when &c and Sayth that he Cannot Gainsay the plft his action afd against him Brought nor Can he Say But that the Bill writing Obligatory afd is his act and deed and that the debt therein Mentioned is yett due and unsatisfied wherefore the Said plft prays Judgm.t for his debt afd and his Costs and damages Sustained by Occasioned of the detaining the same debt to him to be adjudged &c therefore it is Considered by the Justices here the twentieth day of august ann Dom One thousand seven hundred and twenty three that the said John Scott recover against the said John Taylor as well the sume of twenty six pounds six shillings and Eight pence Curr.t money of Maryland his debt afd as also the sume of (362) Three hundred & sixty Two pounds of tob.o by the Court here adjudged unto him for his Costs and Damages sustained by Occasion of the detaineing the same debt to him to be adjudged &c & the deft in Mercy &c |
