103 Recover against the said William Denston Jun as well the sume of six pounds and ten pence Curr.t and (267) Lawfull money ^of England^ the debt afd as also the sume of pounds of tobacco by the Court here adjudged unto them for their Costs and damages by them about their Suite in this Behalfe Laid Out & Expended and the deft in mercy &c
Joseph Gray of a plea of trespass upon the Case &c and that thereof he should not faile &c And the third tuesday of said Joseph Gray by Francis Allen his attorney declares against the Said Nathaniel Horsey in the plea afd as followeth viz.t Somersett County fs.t Nathaniel Horsey late of Coventry Parish in the County of Somersett Gentl was attached to answer unto Joseph Gray of a plea of trespass upon the Case &c And whereupon the same Joseph by Francis Allen his attorney Complains that whereas the afd Nathaniel the second day of July in the Year of Our Lord God One thousand seven hundred and twenty at Somersett County and within the Jurisdiction of this Court was Indebted unto the afd Joseph in the sum of six pounds Curr.t money of his province as by a Certain Note by the said Nathaniel signed here in Court ready to be produced may appear and so thereof being Indebted the afd Nathaniel afterwards to witt the same second day of July in the year afd in the County afd and within the Jurisdiction afd in Consideration thereof upon himselfe did assume and unto the afd Joseph then and there faithfully did promise that he the afd Nathaniell the sume six pounds Curr.t money afd when thereof afterwards he should be required well and faithfully would pay and Content Nevertheless the afd Nathaniel his promise and assumption afd so as it is said Made nothing regarding but minding and fraudulently Intending the same Joseph in this part Craftilly and Subtilly to deceive and defraud the afd six pounds Curr.t money afd or any part thereof unto the Same Joseph hath not paid or in any Sort Contented altho' to do the same the afd Nathaniel afterwards to witt the first day of March in the year of Our Lord God One thousand seven hundred and twenty One and often afterwards at the County afd within the Jurisdiction afd by the afd Joseph he was required but that unto him hitherto to pay or in any Sort to Content altogether hath refused and Still doth refuse to the damage of the said Joseph of twelve pounds money afd and thereupon he bringeth suite &c Allen P Qrte Pledgs deft Jno Doe R Roe Att which said third tuesday of August to witt the twentieth day of the same month annon Dom One thousand seven hundred and twenty three Being the day of the return of the Said Writt Cometh the Said Joseph Gray by his attorney afd and the Sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorst in these words following viz.t Cepi Corpus P me Jos MccClester Whereupon the said Nathaniel Horsey in his Own proper person Cometh and defendeth the force and Injury when &c and saith that he Cannot Gainsay the plft his action afd so as afd against him brought nor Can he say but that the said plft Ought to recover his damages by Occasion of the premisses afd to six pounds Currt money (of) |
